💡 Attention SMME Business Owners & HR Managers: The "Rolling Contract" trap just got slammed by the courts.



If you’ve been renewing fixed-term contracts year after year and thinking, "We can just let it expire when we want to part ways," you need to read this immediately.

The Labour Appeal Court (LAC) recently handed down a massive judgment that changes the game for small businesses using successive fixed-term contracts.



🇿🇦 The Case: Prosper Maphosa & Others v New Model Private College (28 May 2026)

What happened? A group of teachers were kept on rolling 12-month contracts for up to 10 years. In late 2020, the school told them their contracts were "expiring," told them to re-apply, and then locked them out while hiring replacements.

The Court’s Verdict: The court didn't buy it. Because these employees earned below the BCEA threshold and there was no justifiable reason to keep them temporary, the law automatically deemed them permanent after 3 months. The school’s defense that the "contract expired" had zero basis in law. The CCMA's award of 12 months’ compensation was upheld.



⚖️ The Golden Rule for SMMEs: By law (Section 198B), you cannot keep an employee on a fixed-term contract for longer than 3 months unless you have a valid, justifiable reason (e.g., covering maternity leave, a specific short-term project). If you don't have a justifiable reason, they are automatically permanent.



Stop using fixed-term contracts as a loophole to avoid employment obligations. It will backfire.
