KIMBERLEY HIGH COURT PROTECTS COMMUNITY INTERESTS IN R5 BILLION INFRASTRUCTURE DISPUTE

KIMBERLEY – The Kimberley High Court has dealt a significant blow to the PowerChina and Sinohydro Joint Venture (JV) by dismissing their urgent application (Case No: 2026-088296) against the Emthanjeni Community.

The dispute involves what is recognized as one of the largest infrastructure projects in South African history, with an estimated value of R5 Billion per phase. The 1st Respondent, Mr. Sabelo Tabata of the Emthanjeni Taxi Association, and the 3rd Respondent, Mr. Sandile Makhandula of the Emthanjeni Business Chamber, argued that the JV must honor its contractual obligations to the community.

By dismissing the matter on the roll, the Court has effectively ruled that the JV's attempt to bypass community engagement via urgent legal channels was not justified.

"This project is a cornerstone of our local economy," said a spokesperson for the Respondents. "We will not allow international firms to ignore contractual obligations that ensure our local businesses and workers benefit from the resources in our own backyard."

Agreement Reached with Emthanjeni Taxi Committee for Staff Transportation!

We're excited to announce that we've had a highly productive meeting with the local taxi committee, reaching a significant agreement and consensus regarding local inclusivity for staff transportation.

This collaboration aims to ensure reliable and accessible transport for all our staff members. To facilitate the administration and management of this new transportation system, a joining fee will be required from everyone who wishes to be included in the staff transportation service.

We believe this agreement will greatly benefit our community, and we look forward to working together with the taxi committee to implement a smooth and efficient transportation solution.
More details on how to join and pay the fee will be shared shortly. Thank you for your understanding and cooperation!

We are meeting tomorrow 7h00 - De Aar East - Civic Hall
De Aar West - Nonzwakazi Hall.

By tomorrow all our demands must be met. As the community we have been submitting CVs and registering our businesses to Sofisa Phillips which is the CRM office.

Two new Chinese companies has brought influx of outside ppl to work on project of Mulilo Total Hydra Storage.

We can’t allow such Mediocre to take place. We have people that were trained by DMRE who can do solar PV installation. We have companies like New Tech who can do PV installation and pile drilling, with all other local SMMEs that can do that scope of work. These new companies are not even from local. Not even registered on Sofisa Phillips database yet it’s allowed to work and take this scope of work which could have been done by our locals.

KRJ and CBMI must leave and we demand POWERCHINA to employ local skilled people with labourers and local companies to do this scope of work. This demand is immediate. Site must remain closed till our demands as community are met.

Enough Is Enough.

People of De Aar let’s stand together. We need to support each other to achieve what came to progress us.

Sooner or later these IPPs will leave our town and what is that they will be leaving behind? Nothing!!!

Employment for locals has been tempered, our local people are paid peanuts, and are mistreated and contracts are wrongly terminated. Influx of chinese migrants/ workers in particular other foreign migrants has taken our brothers and sisters bread. There’s no skills transfer and any relevant trade our people has received from these companies.

Local SMMEs, benefits nowhere in the entire process. Companies from outside this municipality and province have occupied our space and took our bread. No RFQ process they are just appointed. Fencing does not require specialised skill yet is sourced from outside this community.

Transportation of staff, bogus transport committee came to our town and start threatening people and occupied the space. Their style of work which forms gangsterism has caused many to suffer and left out. People are asked pay 7.5k or 5k to participate in opportunities of this kind. Even this establishment of this bogus taxi committee consists of outsiders. Today we see influx of taxi’s that are from outside.

THIS IS LAST UPDATE ABOUT THESE SOLAR COMPANIES ON THIS PLATFORM. THE NEXT STEP IS CLOSE THEM DOWN TILL OUR GRIEVANCES ARE MET AS DIRECT BENEFICIARIES.

Security Companies are from outside and they’ve hired people from outside.

Labour, Skilled and semi skilled from outside.

Taxis or transport services dictated by outsiders.

CRM and administrative work run by outsiders.

Why is always the case that people of De Aar inclusive of other town within Emthanjeni has to fight for what belongs to them. Why should we beg and nurse people who are taking our bread. These solar companies came to benefit us as Emthanjeni communities. No one will be left behind everyone will benefit specifically Emthanjeni Residents.

GREAT WAR IS COMING. WE WILL NOT LET IT GO. WE WILL LIBERATE OUR COMMUNITY IN DUE- SOON. THESE. OPPORTUNITIES ARE FOR US NOT OUTSIDERS.

The objective of these IPP projects is to create opportunities to develop and grow our communities.

All disadvantaged groups remains poor due to a fact that our very own people employed by those solar companies seeks to benefit indirectly and directly. We have noted the appointment letters given to advantage group, both black and coloureds should submit for RFQs. If. There’s transparency within tendering process why not all of us receive appointment letters.

Director beneficiaries remains excluded in all business aspects. For people to venture into those opportunities they are asked to pay certain amount of fee. People are asked to pay fees of affiliations on private projects.

The same administrators who came and present the opportunities to us are captured in the process.

We all must applaud the Hanover Community for what they did yesterday in Solar Africa Energy.

If you look at the employment stats within these solar projects 60% are people from outside, it’s the same with transport (taxi) services. It’s high time we stand together and liberate our communities from this mediocre processes.

We Demand Inclusivity of;
•Local Businesses
•Local Transport Services
•Local Labour, Semi Skilled and Skilled

Not so long ago Chinese brought number of Chinese to finish of these projects.

DE AAR WILL BE SOMETHING ELSE VERY SOON, IF OUR VOICES ARE NOT HEARD.
WE MUST FIRST CLOSE ALL THESE CRM/ ADMINISTRATION OFFICES WHO PLAYS MIDDLEMAN BETWEN US AND THE DEVELOPER.
