KIMBERLEY HIGH COURT PROTECTS COMMUNITY INTERESTS IN R5 BILLION INFRASTRUCTURE DISPUTE
KIMBERLEY – The Kimberley High Court has dealt a significant blow to the PowerChina and Sinohydro Joint Venture (JV) by dismissing their urgent application (Case No: 2026-088296) against the Emthanjeni Community.
The dispute involves what is recognized as one of the largest infrastructure projects in South African history, with an estimated value of R5 Billion per phase. The 1st Respondent, Mr. Sabelo Tabata of the Emthanjeni Taxi Association, and the 3rd Respondent, Mr. Sandile Makhandula of the Emthanjeni Business Chamber, argued that the JV must honor its contractual obligations to the community.
By dismissing the matter on the roll, the Court has effectively ruled that the JV's attempt to bypass community engagement via urgent legal channels was not justified.
"This project is a cornerstone of our local economy," said a spokesperson for the Respondents. "We will not allow international firms to ignore contractual obligations that ensure our local businesses and workers benefit from the resources in our own backyard."
