Migrant are sending a clear message: Migration without rights is exploitation. ✊🏿

Across the world, migrant domestic workers continue to face exclusion from labour protections, barriers to justice, and unsafe working conditions.

At the , we call for migration systems that guarantee:
➡️ Labour rights
➡️ Access to justice
➡️ Protection across borders
➡️ Care policies aligned with ILO Convention 189

Dignity, protection, and rights must be at the center of migration governance.

Employers in South Africa cannot legally employ foreign nationals without valid work authorisation.

Section 8(1) of the Employment Services Act states:

«“An employer may not employ a foreign national within the territory of the Republic of South Africa prior to such foreign national producing an applicable and valid work permit, issued in terms of the Immigration Act.”»

Employers who break this law may face:
⚠ Labour inspections
⚠ Fines and penalties
⚠ Criminal charges
⚠ Liability for UIF, COIDA and tax non-compliance
⚠ Possible imprisonment in serious cases

Section 9 also prohibits employers from allowing foreign nationals to perform work outside the conditions of their permits.

But enforcement must never be used to promote xenophobia. Exploitative employers often target vulnerable migrant workers to avoid complying with labour laws and to drive down wages and working conditions for everyone.

Workers’ rights are human rights.
The law must protect all workers while holding unlawful employers accountable.

I recently joined Lester Kiewit on CapeTalk to unpack the real struggles many domestic workers face daily — from non-registration for UIF to denial of basic labour rights.

📢 Important reminder to all employers:
If your domestic worker works more than 24 hours per month, UIF registration is a LEGAL REQUIREMENT — not a favour.

This includes:
✔️ Nannies
✔️ Gardeners
✔️ Caregivers

We must build a society that respects and protects care workers.
