| South African Steelworks v MEIBC and Others [2025] 3 BLLR 257 (LAC)

When employees refuse to work a new shift system, is it misconduct or an unprotected strike?

The Labour Appeal Court confirmed that a refusal to obey a lawful instruction about working hours is misconduct, not a strike. The employer had the right to determine shift patterns. The instruction was lawful.

The legal principle is that a refusal to obey a lawful instruction about when to work is misconduct, not a strike.
