اللجنة الوطنية للتحقيق تباشر تحقيقاتها الميدانية في وقائع قصف مطار عدن الدولي

نفذت اللجنة الوطنية للتحقيق في ادعاءات انتهاكات حقوق الإنسان، اليوم الثلاثاء، نزولاً ميدانياً إلى مطار عدن الدولي، للتحقيق في وقائع القصف بالصواريخ الباليستية والطائرات المسيّرة التي نفذتها جماعة الحوثي على المطار أيام 7 و11 و16 أكتوبر الجاري، وتوثيق الأضرار الناجمة عنها وتأثيرها على حركة الطيران وسلامة الركاب والعاملين.

وعقد فريق اللجنة، برئاسة القاضي أحمد سعيد المفلحي، لقاءً مع مدير المطار، سقاف علي السقاف، اطّلع خلاله على تفاصيل الاستهداف، والإجراءات الاحترازية التي اتخذتها إدارة المطار لحماية الركاب والموظفين، وما فرضته الهجمات من قيود على التشغيل.

واطّلع الفريق على بقايا الصواريخ والطائرات المسيّرة التي جرى تحريزها، ووثّقها ضمن أعمال جمع الأدلة المتعلقة بالوقائع، كما استمع إلى إفادات وشهادات عدد من المعنيين والعاملين في المطار، بشأن ظروف الاستهداف وتوقيته، وآثاره على سير العمل، والإجراءات التي اتُخذت أثناء الهجمات وفي أعقابها.

وأكد رئيس اللجنة، القاضي أحمد سعيد المفلحي، أن التحقيق في هذه الوقائع يستند إلى المعاينة الميدانية، والاستماع إلى الشهادات، وجمع الأدلة وفحصها، وصولاً إلى تحديد ملابسات الهجمات والمسؤولية عنها، مشدداً على أهمية توثيق آثارها على سلامة المدنيين والعاملين وحركة الطيران في هذا المرفق الحيوي.

من جانبه أوضح مدير المطار، أن الاستهداف ألحق أضراراً بالمدرج ومرافق المطار، واستدعى اتخاذ إجراءات احترازية لحماية الركاب والموظفين، مؤكداً تعاون إدارة المطار مع اللجنة وتوفير المعلومات اللازمة لاستكمال التحقيق.

وسيواصل فريق اللجنة استكمال إجراءات التحقيق في الوقائع، وجمع الإفادات والأدلة ذات الصلة وتحليلها، لاستكمال ملفات التحقيق وتحديد نتائجه.

National Commission Holds Training Workshop on International Law and Investigation Methodologies

The National Commission to Investigate Alleged Violations of Human Rights, in cooperation with the Office of the United Nations High Commissioner for Human Rights (OHCHR), organized a training workshop in the temporary capital, Aden, on “International Law and Investigation Methodologies.” The workshop aimed to strengthen the capacities of the Commission’s assistant investigators in the legal characterization of violations, evidence collection and analysis, and the development of investigation files.

The four-day programme covered relevant frameworks under international human rights law, international humanitarian law, and national law, as well as rules governing the protection of civilians and civilian objects, the legal characterization of violations, individual responsibility, and command responsibility. It also addressed investigation planning, interview preparation, the assessment of witness credibility, standards for collecting and preserving evidence, and the review of case files.

The workshop included dedicated sessions on digital investigations and open-source information, the verification and geolocation of images and videos, and the documentation of the recruitment and use of children in armed conflict. It also covered child-sensitive interviewing and safeguards for their protection. Practical exercises focused on developing investigation plans and evidence matrices, drafting reports and legal memoranda, and linking facts and evidence to legal analysis.

During the workshop, the Commission’s Chairperson, Judge Ahmed Saeed Al-Muflihi, emphasized the importance of strengthening the capacities of the Commission’s personnel to ensure the quality and accuracy of investigations. He noted that documenting violations and developing investigation files require professional work grounded in evidence and sound legal analysis, contributing to safeguarding victims’ rights and supporting efforts to achieve justice. He also expressed his appreciation for the cooperation with OHCHR and its technical support for the Commission’s work.

For his part, Ahmed Suleiman, OHCHR’s Resident Representative in Yemen, emphasized the importance of strengthening national capacities to investigate human rights violations. He explained that the programme combined legal frameworks with practical applications, enabling participants to exchange experience and develop their skills in evaluating evidence, verifying information, and formulating investigation findings in accordance with professional standards.

Chair of (NCIAVHR) Visits Wounded Civilians and Conflict-Related Detainees in Aden

The Chair of the National Commission to Investigate Alleged Violations of Human Rights in Yemen, Judge Ahmed Saeed Al-Muflihi, conducted a field visit today to Aboud Hospital in Aden Governorate to assess the conditions of wounded civilians and people detained in connection with the conflict, review the medical care provided to them, and examine the nature of the violations suffered by civilians.

Accompanied by Commission member Judge Jihad Abdulrasool, Judge Al-Muflihi visited several civilians wounded in shelling and listened to their testimonies. He also reviewed the conditions of several wounded conflict-related detainees brought from areas of active fighting and the medical care they were receiving at the hospital. They included two children who had been recruited by the Houthi group and involved in military operations.

According to information provided during the visit, the hospital has received 37 injury cases since September, while two wounded patients—a man and a woman—were referred to other hospitals for further treatment. Those injured included children and women, with some sustaining serious injuries requiring surgery and intensive care.

The Commission’s team heard accounts of several incidents affecting civilian families, including the shelling of an area where a family was celebrating a relative’s wedding. According to preliminary information, the incident killed the mother and injured several children aged between one and ten. The cases also included a five-year-old boy injured when a ballistic missile landed near his maternal uncle’s home, destroying the house and injuring several people inside.

The team reviewed the medical services provided to the wounded, including surgical procedures, follow-up care for injuries, and psychological support for those affected by trauma. It also reviewed the efforts of medical staff and emergency teams to meet their treatment needs.

اللجنة الوطنية للتحقيق تنظم ورشة تدريبية حول القانون الدولي ومنهجيات التحقيق

نظمت اللجنة الوطنية للتحقيق في ادعاءات انتهاكات حقوق الإنسان، بالتعاون مع المفوضية السامية للأمم المتحدة لحقوق الإنسان، بالعاصمة المؤقتة عدن، ورشة تدريبية حول "القانون الدولي ومنهجيات التحقيق"، لتعزيز قدرات محققيها المساعدين في التكييف القانوني للانتهاكات وجمع الأدلة وتحليلها وبناء ملفات التحقيق.

وتناول البرنامج الذي استمر أربعة أيام، الأطر ذات الصلة في القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني والقانون الوطني، وقواعد حماية المدنيين والأعيان المدنية، والتكييف القانوني للانتهاكات والمسؤولية الفردية ومسؤولية القيادة. كما شمل تخطيط التحقيقات، والتحضير للمقابلات وتقييم مصداقية الشهود، ومعايير جمع الأدلة وحفظها، ومراجعة ملفات القضايا.

وخصصت الورشة جلسات للتحقيقات الرقمية ومصادر المعلومات المفتوحة، والتحقق من الصور ومقاطع الفيديو وتحديد مواقعها الجغرافية، إلى جانب توثيق تجنيد الأطفال واستخدامهم في النزاعات المسلحة وإجراء المقابلات المراعية لاحتياجاتهم وضمانات حمايتهم. وتضمن البرنامج تمارين تطبيقية على إعداد خطط التحقيق ومصفوفات الأدلة وصياغة التقارير والمذكرات القانونية، والربط بين الوقائع والأدلة والتحليل القانوني.

وخلال الورشة، أكد رئيس اللجنة، القاضي أحمد سعيد المفلحي، أهمية تطوير قدرات كوادر اللجنة لضمان جودة التحقيقات ودقتها، مشيراً إلى أن توثيق الانتهاكات وبناء ملفات التحقيق يتطلبان عملاً مهنياً يستند إلى الأدلة والتحليل القانوني السليم، بما يسهم في حفظ حقوق الضحايا ودعم جهود تحقيق العدالة. وأعرب عن تقديره للتعاون مع المفوضية السامية ودعمها الفني لأعمال اللجنة.

من جانبه، أكد الممثل المقيم للمفوضية السامية للأمم المتحدة لحقوق الإنسان بمكتب اليمن، أحمد سليمان، أهمية تعزيز القدرات الوطنية في التحقيق في انتهاكات حقوق الإنسان، موضحاً أن البرنامج جمع بين الأطر القانونية والتطبيقات العملية، وأتاح للمشاركين تبادل الخبرات وتطوير مهاراتهم في تقييم الأدلة والتحقق من المعلومات وصياغة نتائج التحقيق وفق المعايير المهنية.

نفّذ رئيس اللجنة الوطنية للتحقيق في ادعاءات انتهاكات حقوق الإنسان، القاضي أحمد سعيد المفلحي، اليوم، زيارة ميدانية إلى مستشفى عبود بمحافظة عدن، للاطلاع على أوضاع الجرحى من المدنيين والمحتجزين على ذمة الحرب، ومستوى الرعاية الطبية المقدمة لهم، والوقوف على طبيعة الانتهاكات التي طالت المدنيين.

وتفقد القاضي المفلحي ومعه عضو اللجنة القاضية جهاد عبدالرسول عدداً من الجرحى المدنيين الذين أُصيبوا جراء القصف، واستمع إلى إفاداتهم، كما اطّلع على أوضاع عدد من الجرحى المحتجزين على ذمة الحرب القادمين من مناطق الاشتباكات، ومستوى الرعاية الطبية المقدمة لهم في المستشفى، بينهم طفلان جنّدتهما جماعة الحوثي وأشركتهما في العمليات العسكرية.

وبحسب المعلومات المقدمة خلال الزيارة، بلغ عدد حالات الإصابة التي استقبلها المستشفى منذ سبتمبر الماضي 37 حالة، فيما جرى تحويل حالتي إصابة لرجل وامرأة إلى مستشفيات أخرى لاستكمال العلاج. وشملت الإصابات أطفالاً ونساءً، بينها حالات خطرة استدعت تدخلات جراحية ورعاية في العناية المركزة.

واستمع فريق اللجنة إلى عدد من الوقائع التي طالت أسراً مدنية، من بينها قصف منطقة كانت إحدى الأسر تحتفل فيها بزواج أحد أقاربها، ما أسفر، وفق المعلومات الأولية، عن وفاة الأم وإصابة عدد من الأطفال تتراوح أعمارهم بين عام وعشرة أعوام. كما شملت الحالات طفلاً في الخامسة من عمره أُصيب إثر سقوط صاروخ باليستي بالقرب من منزل خاله، ما أدى إلى تدمير المنزل وإصابة عدد من الموجودين فيه.

واطّلع الفريق على الخدمات الطبية المقدمة للجرحى، بما فيها التدخلات الجراحية ومتابعة الإصابات، وخدمات الدعم النفسي للمتضررين من الصدمات، والجهود التي تبذلها الكوادر الطبية وفرق الطوارئ لتلبية احتياجاتهم العلاجية.

Human Rights Council Adopts by Consensus Renewed Support for the Mandate of the National Commission to Investigate and Urges All Parties to Cooperate with It

The United Nations Human Rights Council in Geneva renewed its support today, Wednesday, during its sixty-third session, for the National Commission to Investigate Alleged Violations of Human Rights in Yemen (NCIAVHR) in carrying out its mandate, and urged all parties to the conflict to cooperate with the Commission and facilitate its work.

This came as the Council adopted, without a vote, draft resolution A/HRC/63/L.33 on technical assistance and capacity-building for Yemen in the field of human rights.

The Council requested the High Commissioner to continue providing technical assistance and capacity-building to the Government of Yemen, and to provide all necessary technical and logistical support to the National Commission to Investigate Alleged Violations of Human Rights, enabling it to continue investigating violations and abuses committed by all parties to the conflict in Yemen, in accordance with international standards.

The Council welcomed the progress made by the Commission, particularly its regular field visits across Yemen, consultations with civil society organizations, and publication of periodic reports on various forms of human rights violations and abuses and violations of international humanitarian law committed by all parties to the conflict.

The resolution called on the Office of the United Nations High Commissioner for Human Rights (OHCHR) to continue providing technical assistance and advice to the Commission, at a level of support equivalent to that provided to any commission of inquiry.

مجلس حقوق الانسان يقر بالإجماع تجديد الدعم لولاية اللجنة الوطنية للتحقيق ويحث كافة الأطراف على ضرورة التعاون معها

جدّد مجلس حقوق الإنسان التابع للأمم المتحدة بجنيف، اليوم الأربعاء، في دورته الثالثة والستين، دعمه للجنة الوطنية للتحقيق في ادعاءات انتهاكات حقوق الإنسان في اليمن لأداء ولايتها، وحثّ جميع أطراف النزاع على التعاون معها وتيسير أعمالها.

جاء ذلك باعتماد المجلس دون تصويت مشروع القرار رقم (A/HRC/63/L.33) بشأن المساعدة التقنية وبناء القدرات من أجل اليمن في مجال حقوق الإنسان.

وطلب المجلس من المفوض السامي مواصلة تقديم المساعدة التقنية وبناء القدرات لحكومة اليمن، وتوفير كل الدعم التقني واللوجستي اللازم للجنة الوطنية للتحقيق في ادعاءات انتهاكات حقوق الإنسان، لتمكينها من مواصلة التحقيق في الانتهاكات والتجاوزات المرتكبة من جميع أطراف النزاع في اليمن، بما يتماشى مع المعايير الدولية.

ورحّب المجلس بالتقدم الذي أحرزته اللجنة، ولا سيما الزيارات الميدانية المنتظمة في أنحاء اليمن، والمشاورات مع منظمات المجتمع المدني، وإصدار التقارير الدورية بشأن مختلف أنواع انتهاكات حقوق الإنسان وتجاوزاتها وانتهاكات القانون الدولي الإنساني من جميع أطراف النزاع.

ودعا القرار المفوضية إلى مواصلة تقديم المساعدة التقنية والمشورة للجنة، دعماً يعادل مستواه ما يقدم إلى أي لجنة تحقيق.

National Commission to Investigate Visits Al-Firdous Camp in Aden and Documents Violations Against Displaced Persons

A team from the National Commission to Investigate Alleged Violations of Human Rights, led by the Commission’s Chairperson, Judge Ahmed Saeed Al-Muflihi, and including Commission member Judge Jihad Abdulrasoul, conducted a field visit on Monday to Al-Firdous camp for internally displaced persons in western Aden Governorate. The visit aimed to assess the conditions of displaced persons and document violations they had suffered before fleeing their home areas in the western coastal districts of Taiz and Al-Hudaydah governorates.

The team heard testimonies from several displaced persons about the violations they had experienced and the circumstances that forced them to leave their homes. It documented a number of these violations as part of the Commission’s mandate to monitor, document and investigate alleged human rights violations.

The team reviewed figures showing that 529 families were residing in the camp. Camp officials briefed the team on the continued arrival of displaced persons, their needs, and the local authorities’ efforts to establish a new camp to accommodate people fleeing various areas affected by fighting.

The team assessed living conditions and the basic services available in the camp, including food and shelter. It also examined compliance with humanitarian standards, the protection of displaced persons’ rights, and whether humanitarian and relief assistance was reaching its intended recipients.

The team further assessed the conditions of women, children, older persons and persons with disabilities, including the availability of adequate protection and care, as part of its assessment of the human rights situation in the camp and the needs of those most at risk.

The Commission’s Chairperson instructed field researchers to continue monitoring and documenting all cases of violations affecting displaced persons across displacement camps in Aden Governorate, and to follow up on victims’ testimonies to complete investigations into the incidents they had experienced.

اللجنة الوطنية للتحقيق تزور مخيم الفردوس بعدن وتوثق انتهاكات تعرض لها النازحون

نفّذ فريق اللجنة الوطنية للتحقيق في ادعاءات انتهاكات حقوق الإنسان، برئاسة القاضي أحمد سعيد المفلحي، وبمشاركة عضو اللجنة القاضية جهاد عبدالرسول، اليوم الاثنين، نزولاً ميدانياً إلى مخيم الفردوس للنازحين غربي محافظة عدن، للاطلاع على أوضاع النازحين وتوثيق الانتهاكات التي تعرضوا لها قبل نزوحهم من مناطقهم في مديريات الساحل الغربي بمحافظتي تعز والحديدة.

واستمع الفريق إلى إفادات عدد من النازحين حول الانتهاكات التي طالتهم والظروف التي دفعتهم إلى مغادرة مناطقهم، ووثّق عدداً من تلك الانتهاكات، في إطار مهام اللجنة في الرصد والتوثيق والتحقيق في ادعاءات انتهاكات حقوق الإنسان.

واطّلع فريق الفريق على إحصائيات الأسر المقيمة في المخيم، والبالغ عددها 529 أسرة، واستمعوا من مسؤولي المخيم إلى شرح حول استمرار توافد النازحين واحتياجاتهم، وجهود السلطة المحلية لافتتاح مخيم جديد لاستيعاب القادمين من مناطق الاشتباكات المختلفة.

وعاين الفريق الظروف المعيشية والخدمات الأساسية المتاحة داخل المخيم، بما فيها الغذاء والإيواء، ومدى الالتزام بالمعايير الإنسانية وحماية حقوق النازحين، والتحقق من وصول المساعدات الإنسانية والإغاثية إلى مستحقيها.

كما تفقد أوضاع النساء والأطفال وكبار السن والأشخاص ذوي الإعاقة، ومدى توفر الحماية والرعاية اللازمة لهم، ضمن تقييم أوضاع حقوق الإنسان في المخيم والوقوف على احتياجات الفئات الأكثر عرضة للمخاطر.

ووجّه رئيس اللجنة الباحثين الميدانيين بمواصلة رصد وتوثيق جميع حالات الانتهاك بين النازحين في كافة مخيمات النزوح المنتشرة بمحافظة عدن، ومتابعة إفادات الضحايا لاستكمال إجراءات التحقيق في الوقائع التي تعرضوا لها.

National Commission Discusses Its Fourteenth Report and Human Rights Developments with the U.S. Mission in Geneva

The Chair and members of the National Commission to Investigate Alleged Violations of Human Rights met with two representatives of the U.S. Mission in Geneva to discuss the findings of the Commission’s fourteenth periodic report and developments in the human rights situation in Yemen, in light of the recent military escalation and its impact on civilians.

The Commission’s Chair, Judge Ahmed Saeed Al-Muflahi, outlined key incidents covered in the report, including violations associated with attacks on maritime navigation and their repercussions. He also reviewed the report’s recommendations to the international community and called for action to implement them.

The meeting addressed recent attacks on several districts, the resulting violations and growing humanitarian needs. Judge Al-Muflahi urged support for humanitarian response plans to address the emergency. The two sides also discussed ways to provide the Commission with technical assistance under the Human Rights Council resolution concerning support for its work.

Shamis Mahmoud, First Secretary for Economic and Political Affairs at the U.S. Mission, commended the Commission’s efforts to document human rights violations despite the challenges it faces. Sarah Al-Sayed, the Mission’s Peace and Security Officer in its Multilateral Economic and Political Affairs Section, also attended the meeting.
