𝐍𝐆𝐀 𝐏𝐋𝐀𝐆𝐀 𝐃𝐑𝐄𝐉𝐓 𝐃𝐑𝐄𝐉𝐓Ë𝐒𝐈𝐒Ë: 𝐊𝐎𝐍𝐅𝐈𝐑𝐌𝐎𝐇𝐄𝐓 𝐃Ë𝐍𝐈𝐌𝐈 𝐌𝐄 𝟑𝟎 𝐕𝐉𝐄𝐓 𝐁𝐔𝐑𝐆𝐈𝐌 𝐍Ë 𝐑𝐀𝐒𝐓𝐈𝐍 𝐄 𝐌𝐁Ë𝐒𝐇𝐓𝐄𝐓𝐔𝐑 𝐍𝐆𝐀 𝐐𝐊𝐑𝐌𝐓-𝐉𝐀
Qendra Kosovare për Rehabilitimin e të Mbijetuarve të Torturës (QKRMT) mirëpret vendimin e Gjykatës së Apelit, e cila ka vërtetuar në tërësi dënimin e shqiptuar nga Gjykata Themelore në Prishtinë – Departamenti Special, në vitin 2025, ndaj Ivica Rajkoviq dhe Dragan Deniq, të akuzuar për veprën penale “Krimet e luftës kundër popullsisë civile”, përkatësisht për dhunën seksuale të kryer ndaj një gruaje gjatë luftës në Kosovë. Të dy të akuzuarit janë dënuar me nga 15 vjet burgim, apo 30 vjet burgim në total.
Ky është rasti i parë në Kosovë ku dy persona të akuzuar për dhunë seksuale gjatë luftës janë 𝐠𝐣𝐲𝐤𝐮𝐚𝐫 𝐝𝐡𝐞 𝐬𝐡𝐩𝐚𝐥𝐥𝐮𝐫 𝐟𝐚𝐣𝐭𝐨𝐫ë 𝐧ë 𝐦𝐮𝐧𝐠𝐞𝐬ë, dhe tashmë dënimi i tyre është vërtetuar edhe nga Gjykata e Apelit. Njëkohësisht, ky përbën dënimin më të lartë të konfirmuar deri më tani për një rast të dhunës seksuale gjatë luftës, me nga 15 vjet burgim për secilin të dënuar.
Në këtë proces të gjatë dhe të vështirë, 𝐐𝐊𝐑𝐌𝐓 𝐤𝐚 𝐪𝐞𝐧ë 𝐩𝐫𝐚𝐧ë 𝐭ë 𝐦𝐛𝐢𝐣𝐞𝐭𝐮𝐚𝐫ë𝐬 𝐪ë 𝐧𝐠𝐚 𝐯𝐢𝐭𝐢 𝟐𝟎𝟏𝟒, kur ajo iu drejtua QKRMT-së pas vitesh të tëra izolimi dhe vuajtjeje të thellë si pasojë e traumave të shkaktuara nga dhuna seksuale e përjetuar gjatë luftës. Përmes shërbimeve të integruara psikosociale, mjekësore dhe ligjore, QKRMT e ka mbështetur të mbijetuarën në rrugëtimin e saj drejt rehabilitimit dhe drejtësisë. Që nga përgatitja e rastit dhe referimi i tij në sistemin e drejtësisë, e deri te përfundimi i procesit gjyqësor, stafi profesional i QKRMT-së kanë qëndruar përkrah saj dhe familjes së saj, ndërsa QKRMT ka siguruar edhe përfaqësimin ligjor përmes angazhimit të avokatit.
Për QKRMT-në, ky vendim është shumë më tepër se një dënim penal. Ai përfaqëson një njohje të rëndësishme institucionale të së vërtetës së përjetuar nga e mbijetuara dhe një hap të rëndësishëm drejt drejtësisë për të mbijetuarat e dhunës seksuale gjatë luftës në Kosovë. Mbi të gjitha, ky është një moment i rëndësishëm për të mbijetuarën dhe familjen e saj, të cilët për vite me radhë kanë përballuar pasojat e rënda të krimit dhe një rrugëtim të gjatë, të dhimbshëm dhe të vështirë drejt drejtësisë.
𝟓 𝐭ë 𝐝ë𝐧𝐮𝐚𝐫, 𝟕𝟏 𝐯𝐣𝐞𝐭 𝐛𝐮𝐫𝐠𝐢𝐦 – 𝐫𝐞𝐳𝐮𝐥𝐭𝐚𝐭 𝐢 𝐧𝐣ë 𝐚𝐧𝐠𝐚𝐳𝐡𝐢𝐦𝐢 𝐭ë 𝐩𝐚𝐧𝐝ë𝐫𝐩𝐫𝐞𝐫ë 𝐩ë𝐫 𝐝𝐫𝐞𝐣𝐭ë𝐬𝐢.
𝐌𝐞 𝐤ë𝐭ë 𝐯𝐞𝐧𝐝𝐢𝐦, 𝐧𝐮𝐦𝐫𝐢 𝐢 𝐩𝐞𝐫𝐬𝐨𝐧𝐚𝐯𝐞 𝐭ë 𝐝ë𝐧𝐮𝐚𝐫 𝐩ë𝐫 𝐝𝐡𝐮𝐧ë𝐧 𝐬𝐞𝐤𝐬𝐮𝐚𝐥𝐞 𝐭ë 𝐤𝐫𝐲𝐞𝐫 𝐠𝐣𝐚𝐭ë 𝐥𝐮𝐟𝐭ë𝐬 𝐧ë 𝐊𝐨𝐬𝐨𝐯ë 𝐚𝐫𝐫𝐢𝐧 𝐧ë 𝐩𝐞𝐬ë, 𝐧𝐝ë𝐫𝐬𝐚 𝐝ë𝐧𝐢𝐦𝐞𝐭 𝐞 𝐬𝐡𝐪𝐢𝐩𝐭𝐮𝐚𝐫𝐚 𝐧𝐝𝐚𝐣 𝐭𝐲𝐫𝐞 𝐚𝐫𝐫𝐢𝐣𝐧ë 𝐧ë 𝐠𝐣𝐢𝐭𝐡𝐬𝐞𝐣 𝟕𝟏 𝐯𝐣𝐞𝐭 𝐛𝐮𝐫𝐠𝐢𝐦.
Secili prej këtyre rasteve ka një histori të gjatë pas vetes. Që nga identifikimi dhe mbështetja e të mbijetuarave, përgatitja e rasteve, dokumentimi dhe referimi i tyre tek institucionet e drejtësisë, e deri te përfaqësimi dhe mbështetja gjatë proceseve gjyqësore, QKRMT ka qenë e angazhuar drejtpërdrejt në të gjitha këto raste. Këto 71 vjet burgim nuk janë vetëm një shifër, por ato përfaqësojnë vite të tëra pune, guximin e të mbijetuarave për të folur, përballjen e tyre me traumën dhe sistemin e drejtësisë, si dhe përpjekjen e vazhdueshme për të siguruar që dhuna seksuale gjatë luftës të trajtohet si krim dhe që autorët të mbajnë përgjegjësi.
QKRMT mbetet e përkushtuar që, krahas rehabilitimit dhe mbështetjes së të mbijetuarave, të vazhdojë të kontribuojë në dokumentimin, përgatitjen dhe ndjekjen e rasteve të dhunës seksuale gjatë luftës, deri në vendosjen e drejtësisë për të mbijetuarit dhe përgjegjësinë për autorët e këtyre krimeve.
QKRMT gjithashtu vlerëson lart punën e Prokurorisë dhe gjykatave në trajtimin profesional dhe me dinjitet të të mbijetuarës gjatë proceseve të dhënies së dëshmisë dhe zhvillimit të procedurave gjyqësore. Një qasje e tillë institucionale është thelbësore për të krijuar besim tek të mbijetuarat dhe për të inkurajuar raportimin dhe ndjekjen e rasteve të tjera të krimeve seksuale të kryera gjatë luftës.

𝐅𝐑𝐎𝐌 𝐖𝐎𝐔𝐍𝐃𝐒 𝐓𝐎 𝐉𝐔𝐒𝐓𝐈𝐂𝐄: 𝟑𝟎-𝐘𝐄𝐀𝐑 𝐏𝐑𝐈𝐒𝐎𝐍 𝐒𝐄𝐍𝐓𝐄𝐍𝐂𝐄 𝐔𝐏𝐇𝐄𝐋𝐃 𝐈𝐍 𝐂𝐀𝐒𝐄 𝐒𝐔𝐏𝐏𝐎𝐑𝐓𝐄𝐃 𝐁𝐘 𝐊𝐑𝐂𝐓
The Kosova Rehabilitation Centre for Torture Victims (KRCT) welcomes the decision of the Court of Appeals, which fully upheld the sentence imposed by the Basic Court in Prishtina – Special Department in 2025 against Ivica Rajković and Dragan Denić, who were convicted of the criminal offence of “War Crimes against the Civilian Population,” specifically for the sexual violence committed against a woman during the war in Kosovo. Both defendants were sentenced to 15 years in prison, amounting to a total of 30 years.
This is the first case in Kosovo in which two individuals accused of wartime sexual violence have been 𝐭𝐫𝐢𝐞𝐝 𝐚𝐧𝐝 𝐜𝐨𝐧𝐯𝐢𝐜𝐭𝐞𝐝 𝐢𝐧 𝐚𝐛𝐬𝐞𝐧𝐭𝐢𝐚, and the sentences have now also been upheld by the Court of Appeals. At the same time, this represents the highest sentence confirmed to date in a case of wartime sexual violence, with each convicted individual receiving a 15-year prison sentence.
Throughout this long and difficult process, 𝐊𝐑𝐂𝐓 𝐡𝐚𝐬 𝐬𝐭𝐨𝐨𝐝 𝐚𝐥𝐨𝐧𝐠𝐬𝐢𝐝𝐞 𝐭𝐡𝐞 𝐬𝐮𝐫𝐯𝐢𝐯𝐨𝐫 𝐬𝐢𝐧𝐜𝐞 𝟐𝟎𝟏𝟒, when she first approached KRCT after years of isolation and profound suffering resulting from the trauma caused by the sexual violence she experienced during the war. Through integrated psychosocial, medical and legal services, KRCT has supported the survivor throughout her journey towards rehabilitation and justice. From preparing the case and referring it to the justice system, through to the conclusion of the judicial proceedings, KRCT’s professional staff have remained by her side and that of her family. KRCT also secured legal representation through the engagement of a lawyer.
For KRCT, this decision represents far more than a criminal conviction. It constitutes an important institutional recognition of the truth experienced by the survivor and a significant step towards justice for survivors of wartime sexual violence in Kosovo. Above all, this is an important moment for the survivor and her family, who for years have endured the severe consequences of the crime, as well as a long, painful and difficult journey towards justice.
𝟓 𝐂𝐎𝐍𝐕𝐈𝐂𝐓𝐄𝐃, 𝟕𝟏 𝐘𝐄𝐀𝐑𝐒 𝐈𝐍 𝐏𝐑𝐈𝐒𝐎𝐍 – 𝐓𝐇𝐄 𝐑𝐄𝐒𝐔𝐋𝐓 𝐎𝐅 𝐀 𝐂𝐎𝐍𝐓𝐈𝐍𝐔𝐎𝐔𝐒 𝐂𝐎𝐌𝐌𝐈𝐓𝐌𝐄𝐍𝐓 𝐓𝐎 𝐉𝐔𝐒𝐓𝐈𝐂𝐄.
𝐖𝐢𝐭𝐡 𝐭𝐡𝐢𝐬 𝐝𝐞𝐜𝐢𝐬𝐢𝐨𝐧, 𝐭𝐡𝐞 𝐧𝐮𝐦𝐛𝐞𝐫 𝐨𝐟 𝐢𝐧𝐝𝐢𝐯𝐢𝐝𝐮𝐚𝐥𝐬 𝐜𝐨𝐧𝐯𝐢𝐜𝐭𝐞𝐝 𝐨𝐟 𝐬𝐞𝐱𝐮𝐚𝐥 𝐯𝐢𝐨𝐥𝐞𝐧𝐜𝐞 𝐜𝐨𝐦𝐦𝐢𝐭𝐭𝐞𝐝 𝐝𝐮𝐫𝐢𝐧𝐠 𝐭𝐡𝐞 𝐰𝐚𝐫 𝐢𝐧 𝐊𝐨𝐬𝐨𝐯𝐨 𝐡𝐚𝐬 𝐫𝐞𝐚𝐜𝐡𝐞𝐝 𝐟𝐢𝐯𝐞, 𝐰𝐡𝐢𝐥𝐞 𝐭𝐡𝐞 𝐩𝐫𝐢𝐬𝐨𝐧 𝐬𝐞𝐧𝐭𝐞𝐧𝐜𝐞𝐬 𝐢𝐦𝐩𝐨𝐬𝐞𝐝 𝐨𝐧 𝐭𝐡𝐞𝐦 𝐚𝐦𝐨𝐮𝐧𝐭 𝐭𝐨 𝐚 𝐭𝐨𝐭𝐚𝐥 𝐨𝐟 𝟕𝟏 𝐲𝐞𝐚𝐫𝐬.
Each of these cases has a long history behind it. From identifying and supporting survivors, preparing cases, documenting and referring them to the justice institutions, to providing legal representation and support throughout the judicial proceedings, KRCT has been directly engaged in all of these cases. These 71 years of imprisonment are not merely a number, they represent years of work, the courage of survivors to speak out, their confrontation with trauma and the justice system, and the continued effort to ensure that wartime sexual violence is treated as a crime and that perpetrators are held accountable.
Given that the convicted individuals were tried and sentenced in absentia, KRCT expects justice to be carried through to its full implementation and for the convicted individuals, sooner or later, to be brought before the authorities and begin serving their sentences. KRCT calls on the responsible institutions to take all necessary measures and make use of the available mechanisms to bring them before the competent authorities, so that the sentences confirmed by the courts do not remain merely on paper, but are enforced and justice for the survivor is fully realized.
KRCT remains committed, alongside its work on the rehabilitation and support of survivors, to continuing its contribution to the documentation, preparation and pursuit of cases of wartime sexual violence, until justice is secured for survivors and perpetrators are held accountable for these crimes.
KRCT also highly appreciates the work of the Prosecution and the courts in treating the survivor with professionalism and dignity throughout the process of giving testimony and the conduct of the judicial proceedings. Such an institutional approach is essential to building survivors’ trust in the justice system and encouraging the reporting and prosecution of other cases of sexual violence committed during the war.
