Një delegacioni i Komitetit për Parandalim të Torturës (CPT/KPT) i Këshillit të Evropës vizitoi Kosovën në fillim të muajit shkurt 2026.

IAPK me 09 shkurt 2026 takoi anëtarët e delegacionit dhe i informoi për reformat ligjore, zhvillimet dhe arritjet e SHKK-së në përspektivën e të drejtave të njeriut në institucionet korrektuese dhe sfidat aktuale.

Në bazë të zhvillimeve në pesë vitet e fundit nga vzita e KTP në Kosovë (2020), IAPK pret një vlerësim pozitiv të gjendjes së përgjithshme në vendet e privimit të lirisë e veçmas në burgjet e Kosovës.

A delegation of the Committee for the Prevention of Torture (CPT) of the Council of Europe visited Kosovo at the beginning of February 2026.

On 9 February 2026, the Institute for Correctional Policy Advocacy (IAPK) met the delegation and informed them about the legal reforms, developments, and achievements of the KCS from a human rights perspective in correctional institutions, as well as the current challenges.

Based on the developments over the past five years since the CPT’s visit to Kosovo in 2020, the IAPK expects a positive assessment of the overall situation in places of deprivation of liberty, particularly in Kosovo’s prisons

Mbrojtja e jetës në burgje është detyrim ligjor/institucional

Një hulumtim i vlefshëm mbi shkaqet e vetëvrasjeve, veçanërisht ato në institucionet korrektuese, në të cilin kontribuoj edhe IAPK, tregon qartë nevojën për një qasje urgjente dhe të koordinuar institucionale për parandalimin e vetëvrasjeve në burgje.

Institucionet përgjegjëse – Ministria e Drejtësisë, Ministria e Shëndetësisë, SHKK dhe DSHB, duhet të forcojnë vlerësimin (screening) e shëndetit mendor që në fazën e paraburgimit; rrisin kapacitetet për trajtim të detyrueshëm jashtë sistemit korrektues dhe të sigurojnë zbatimin e plotë të urdhrave gjyqësorë për dërgimin e personave me çrregullime të rënda mendore në institucione specialistike, përfshirë IPFK-në.

Mbajtja e këtyre personave në qendra paraburgimi, për shkak të mungesës së kapaciteteve, jo vetëm rrit rrezikun për vetëvrasje, por përbën edhe shqetësim serioz nga perspektiva e të drejtave të njeriut.

Po ashtu, kërkohet investim i qëndrueshëm në burime njerëzore dhe shërbime psikosociale brenda burgjeve, përfshirë rritjen e stafit psikiatrik, mbështetjen psikologjike të vazhdueshme dhe mekanizma efektivë monitorimi për personat me rrezik të shtuar. Funksionalizimi dhe zgjerimi i kapaciteteve të institucioneve si Pavioni D në Dubravë, si dhe bashkëpunimi me shërbime mbështetëse në komunitet, janë hapa konkretë drejt uljes së vetëvrasjeve dhe garantimit të dinjitetit dhe jetës së personave të privuar nga liria.

Protecting Life in Prisons is a Legal and Institutional Obligation

A valuable study on the causes of su***de-particularly within correctional institutions, to which IAPK has also contributed, clearly demonstrates the need for an urgent and coordinated institutional approach to preventing su***des in prisons.

The responsible institutions: the Ministry of Justice, the Ministry of Health, the Kosovo Correctional Service (KCS), and the Prison Health Department (PHD) must strengthen mental health screening at the pre-trial detention stage; increase capacities for compulsory treatment outside the correctional system; and ensure the full implementation of court orders requiring the transfer of persons with severe mental disorders to specialized institutions, including the Institute of Forensic Psychiatry of Kosova (IFPK).

The continued detention of such individuals in pre-trial detention centers due to capacity constraints not only increases the risk of su***de but also raises serious concerns from a human rights perspective.

Moreover, sustained investment is needed in human resources and psychosocial services within prisons, including the expansion of psychiatric staff, continuous psychological support, and effective monitoring mechanisms for persons at heightened risk. The full operationalization and expansion of capacities of facilities such as Pavilion D in Dubrava, as well as cooperation with community-based support services, represent concrete steps toward reducing su***des and safeguarding the dignity and lives of persons deprived of their liberty.

Ky Hulumtim, pjesë e të ciit është edhe IAPK, sjell në vemëndje përvojat e të dënuarve dhe sfidat reale që i përcjellin ata edhe pasi mbarojnë dënimin. Historitë e dokumentuara tregojnë se pa mbështetje pas lirimit, në kushte të stigmës dhe mungesës së mundësive, gjasat për rikthim në shoqëri dobësohen ndjeshëm!

IAPK e konsideron këtë temë thelbësore për nxitjen e reformave që sigurojnë trajtim të dinjitetshëm, qasje individuale në rehabilitim dhe krijimin e mekanizmave funksionalë të mbështetjes pas lirimit.

This research, in which IAPK has also participated, brings to attention the experiences of convicted persons and the real challenges that follow them even after they have completed their sentence. The documented stories show that without post-release support, and under conditions of stigma and lack of opportunities, the chances of successful reintegration into society are significantly weakened.

IAPK considers this issue essential for promoting reforms that ensure treatment with dignity, individualized approach to rehabilitation, and the establishment of functional post-release support mechanisms.

Duke ju referuar temes ne emisionin Konfront ne KTV me 23 tetor 2025, IAPK vlereson se ideja e transferimit te refugjateve dhe azilkerkuesve nga Mbreteria e Bashkuar ne Kosove pergjithesisht duhet te shihet me kujdes, ne driten e te drejtes nderkombetare humanitare, te drejtave te njeriut si dhe ceshtjeve te sigurise se vendit.

Në procesin e aderimit te Republikës së Kosovës në Këshillin e Evropës, respektimi i te drejtave te njeriut (duke perfshire edhe personat e privuar nga liria, perfshire edhe kategorine e refugjateve dhe azilkerkuesve) eshte shume me rendesi pasi perfaqeson nje prej tri shtyllave ose vlerave qendrore te Keshillit te Evropes se bashku me sundimin e ligjit dhe demokracine.

Edhe pse Kosova nuk eshte pale nenshkruese dhe ne listen e instrumenteve nderkombtare te zbatueshme drejtperdrejte ne rendin juridik te saj nuk perfshihen konventat perkatese per refugjatet, çeshtje thelbesore si mbrojtja, strehimi dhe mireqenia e tyre trajtohen permes Konventes Evropiane per te Drejtat e Njeriut, ndersa interpretimet e GjEDNj-së gjejne zbatim te drejtpërdrejte ne rendin juridik te Kosovës.

Referring to the topic discussed on the 'Konfront" (KTV) on 23 October 2025, IAPK considers that the idea of transferring refugees and asylum seekers from the United Kingdom to Kosovo should generally be approached with caution, in light of international humanitarian law, human rights, and the country’s security considerations.

In the process of Kosovo’s accession to the Council of Europe, the respect for human rights, including the rights of persons deprived of liberty, as well as those of refugees and asylum seekers is of particular importance, as it represents one of the three core pillars or fundamental values of the Council of Europe, alongside the rule of law and democracy.

Although Kosovo is not a signatory party, and the relevant international instruments on refugees are not directly applicable within its legal order, essential issues such as the protection, accommodation, and well-being of refugees and asylum seekers are addressed through the European Convention on Human Rights, while the interpretations of the European Court of Human Rights have direct applicability wi

⏳From a busy summer we step into autumn full of action materializing 3 powerful peer-led trainings with a shared goal: Prevent ill-treatment in closed institutions

👥 80 professionals between June and September, from the Kosovo Correctional Service, Prison Health Department, the Institute of Forensic Psychiatry, the Special Institute for Persons with Learning and Mental Disabilities, as well as representatives of the prison inspectorate and the National Preventive Mechanism came together for three dynamic peer-to-peer sessions grounded in the Istanbul Protocol with the focus on documentation and reporting ill-treatment in prisons and other closed institutions.
🧠 Trained by their own peers—local experts who had completed Training of Trainers—participants sharpened their skills in:
✅ Injury documentation
✅ Legal and medical reporting
✅ Real-world case studies

This cascade approach didn’t just build capacity— by tailoring global human rights standards to local realities, the sessions were relevant, practical and empowering to bring about real results.

⏳Posle zauzetog leta zakoračili smo u jesen punu akcije, materijalizujući 3 snažne obuke vođene od strane vršnjaka sa zajedničkim ciljem: Sprečavanje zlostavljanja u zatvorenim institucijama.

👥 80 stručnjaka između juna i septembra iz Kosovske popravne službe, Odeljenja za zdravlje zatvora, Instituta za forenzičku psihijatriju, Specijalnog instituta za osobe sa smetnjama u učenju i mentalnim teškoćama, kao i predstavnici zatvorskog inspektorata i Nacionalnog preventivnog mehanizma, okupili su se na tri dinamične sesije vršnjaka zasnovane na Istanbulskom protokolu, sa fokusom na dokumentovanje i prijavljivanje zlostavljanja u zatvorima i drugim zatvorenim institucijama.
🧠 Obučeni od strane svojih vršnjaka – lokalnih stručnjaka koji su završili Obuku za trenere – učesnici su usavršili svoje veštine u:
✅ Dokumentovanju povreda
✅ Pravnom i medicinskom izveštavanju
✅ Studijama slučajeva iz stvarnog sveta

Ovaj kaskadni pristup nije samo izgradio kapacitete – prilagođavanjem globalnih standarda ljudskih prava lokalnim stvarnostima, sesije su bile relevantne, praktične i osnažujuće da donesu stvarne rezultate.
