CBAM: RESPONSIBILITIES AND OBLIGATIONS
🇪🇺 EU IMPORTERS
🌍 EXPORTING BUSINESSES
As CBAM enters its implementation phase in 2026, carbon is becoming a factor that directly affects trade with the EU market.
EU importers are directly responsible for fulfilling CBAM obligations, while exporting businesses need to proactively prepare emissions data for their products.
🇪🇺 EU Importers: Directly Responsible for CBAM Compliance
For goods within the scope of CBAM, EU importers need to:
✅ Determine whether the goods fall within the scope of CBAM.
✅ Collect embedded emissions data from non-EU producers.
✅ Report emissions in accordance with the CBAM methodology.
✅ Purchase and surrender the required CBAM Certificates in accordance with applicable regulations.
Therefore, the quality of emissions data provided by producers can directly affect the reporting process and CBAM-related costs of EU importers.
🌍 Exporting Businesses: What Needs to Be Prepared?
Although exporting businesses are not directly responsible for purchasing CBAM Certificates, they need to establish reliable emissions data to provide to their EU partners.
1. Determine the Scope Correctly
Review product codes, products and production processes to determine whether the goods fall within the scope of CBAM and identify the relevant emission sources to be accounted for.
2. Calculate the Product’s Embedded Emissions
Collect data on fuel, electricity, raw materials, production volumes and production processes to calculate the emissions associated with exported goods in accordance with the CBAM methodology.
3. Standardize the Calculation Methodology
Businesses may refer to international standards such as ISO 14064-1 for organizational greenhouse gas inventories and ISO 14067 for product carbon footprints.
⚠️ However, it is important to distinguish that ISO 14064-1 and ISO 14067 are not mandatory certification requirements for businesses exporting under CBAM. Data used for CBAM purposes must comply with the methodologies and requirements established by the EU.
4. Prepare Supporting Data and Documentation
It is not enough to provide a single emissions figure. Businesses should retain data sources, emission factors, calculation methodologies and supporting evidence to ensure that the data can be explained and traced when required.
5. Proactively Reduce Emissions
Once emissions data is available, businesses can identify major emission sources and develop reduction measures to improve their competitiveness.
CBAM: Not Just an EU Importer’s Responsibility
CBAM places direct compliance obligations on EU importers, but the underlying emissions data originates from producers and exporters.
Therefore, exporting businesses need to move beyond simply “having emissions data” toward having data that is calculated using the appropriate methodology, properly supported and traceable.
This will be an important foundation for businesses to maintain relationships with EU customers and adapt to the transition toward low-carbon trade.
