October is Depression Awareness Month. Is depression a disability under the Americans with Disabilities Act (ADA)?

The ADA does not contain a definitive list of medical conditions that constitute disabilities. Instead, the ADA defines a person with a disability as someone who has a physical or mental impairment that substantially limits one or more major life activities, such as working. Depression could be a disability if it meets these criteria.

Can my employer fire me because I have a mental health condition?

An employer does not have to hire or keep someone in a job they cannot perform, or employ someone who poses a “direct threat” to safety, meaning a significant risk of substantial harm to themselves or others. However, an employer cannot rely on myths or stereotypes about a person’s mental health condition when deciding whether they can perform a job or pose a safety risk.

Before an employer can reject someone for a job based on their condition, there must be objective evidence that the person cannot perform the job duties or would create a significant safety risk, even with a reasonable accommodation.

The Center for Transition to Adult Health Care for Youth with Disabilities, a national resource center funded by Administration for Community Living ’s Administration on Disabilities (AoD), has launched a new website to help young people with intellectual and developmental disabilities (I/DD) direct their own transition to the adult health care system.

The site also includes resources developed by Center partners, including Family Voices, Inc. (National), Got Transition, SPAN Parent Advocacy Network, Inc., and two AoD-funded University Centers of Excellence in Development Disabilities (UCEDDs): the Institute for Human Development at UMKC and the Waisman Center at University of Wisconsin-Madison at the University of Wisconsin-Madison. Both of these have done extensive work in the field of healthcare transitions for youth with I/DD.
