Article 718, an amendment to the civil code of York city introduced by Councilwoman Judy Ritter-Dickson, will change the offense of ma*****na (under 30 grams) and related paraphernalia possession from a criminal to civil offense, and introduce a sliding fine system. Fines for using ma*****na in the city will start at $150 for the first offense, double to $300 for a second offense, and $600 for a third offense.

This policy brief prepared by the York County Policy Council examines the arguments for and against passing such legislation, demonstrating clear economic and social benefits while highlighting some public concerns about decriminalizing the drug.

"For the better part of the decade, Democrats have largely argued that drillers are taking advantage of Pennsylvania’s taxpayers because there is no tax on the value of gas extracted, while Republicans have said a severance tax will hurt the gas industry and the per-well impact fee on new wells is sufficient, along with other business taxes paid to the state.

But as the current fiscal year winds down this week and lawmakers again look for ways to generate new recurring revenue to fill a roughly $3 billion structural deficit, the Pennsylvania Budget and Policy Center on Tuesday released a new report urging elected officials to enact some kind of severance tax."
