Upcoming Land Development Board Application for Wednesday, November 6.
TOWNSHIP OF WESTAMPTON LAND DEVELOPMENT BOARD NOTICE OF VIRTUAL PUBLIC HEARING PLEASE TAKE NOTICE that on November 6, 2024, at 7:00 PM, prevailing time, the Township of Westampton Land Development Board (the “Board”) shall hold a virtual public hearing to review and take action upon the application of Spark Car Wash LLC (“Applicant”) for preliminary and final major site plan approval, together with bulk variance and design waiver/exception relief (the “Application”), with respect to property having a street address of 75 Springside Road, in the Township of Westampton, County of Burlington, State of New Jersey, and being designated as Block 204, Lot 4 on the Tax Map of the Township of Westampton (the “Property”). PLEASE TAKE FURTHER NOTICE that Applicant, by way of the Application, proposes the construction of an approximately 3,574 square foot car wash, together with related site improvements, including, but not limited to, vacuums, parking spaces, landscaping, lighting, signage, and stormwater management infrastructure. PLEASE TAKE FURTHER NOTICE that, in connection with the Application, Applicant further seeks the following bulk variances and design waivers/exceptions from the Township of Westampton Code (the “Code”): 1. From Code § 250-16D, Schedule of Area, Yard and Bulk Requirements – Table II, to allow less lot area than required (1 acre required, 0.82 acre proposed [existing non-conformity – no change proposed]); 2. From Code § 250-16D, Schedule of Area, Yard and Bulk Requirements – Table II, to allow less of a side yard setback than required (20 feet required, 2.9 feet proposed); 3. From Code § 250-16D, Schedule of Area, Yard and Bulk Requirements – Table II, to allow greater impervious coverage than permitted (60% permitted, 67.5% proposed); 4. From Code § 250-16F(2) to allow shallower screen plantings along property lines where a nonresidential use abuts another nonresidential use than required (20 feet required, 2.9 feet proposed proposed); 5. From Code § 250-25D(4) to allow a sign to be erected on top of the proposed building where same is not permitted; 6. From Code § 250-25K(1)(a) to allow more façade signs than permitted (1 permitted, 7 proposed); 7. From Code § 250-25K(1)(a) to allow a greater total façade sign area than permitted (40 square feet permitted, 247.5 square feet proposed); 8. From Code § 250-25K(1)(c) to allow more freestanding signs than permitted (1 permitted, 2 proposed); 9. From Code § 250-25K(1)(c) to allow a greater freestanding sign area than permitted (50 square feet permitted, 56.74 square feet per sign proposed); 10. From Code § 250-22Q(6)(a) to allow nonemployee parking spaces that differ in dimension from what is required (10-feet-by-20-feet required, 13-feet-by-19-feet proposed); 11. From Code § 250-22A(1) to allow accessory structures in the front and side yards where they are only permitted in the rear yard; 12. From Code § 250-22C to allow less frontage than required for a corner lot (200 feet required, 197 feet along Springside Road proposed and 161 along Woodlane Road proposed [existing non-conformity – no change proposed]); 13. From Code § 250-22R(1) to allow fewer loading spaces than required (1 required, 0 proposed); 14. From Code § 250-22Q(6)(b) to allow employee parking spaces that are not physically separated from nonemployee parking spaces where such separation is required; 15. From Code § 196-8B(3)(c)[1] to allow fewer trees in the front yard buffer module than required (21 canopy trees and 32 understory/evergreen trees required, 5 canopy trees and 5 understory/evergreen trees proposed); 16. From Code § 196-8B(3)(c)[2] to allow fewer shrubs in the screen planting module than required (105 required, 31 proposed); 17. From Code § 196-8A to allow less of a parking and loading area setback from buildings than required (12 feet required, 5.3 feet proposed); 18. From Code § 196-8B(1) to allow less of a nonresidential to nonresidential screen than required (20 feet required, 2.9 feet proposed); 19. From Code § 196-8D(9)(d) to allow a greater level of illumination along any property boundary line, other than at an entrance or driveway, than permitted (0.1 footcandle permitted, 1.1 footcandles proposed); 20. From Code § 250-22G to allow a greater average light intensity than permitted (0.5 footcandle permitted, 2.2 footcandles proposed); and 21. From Code § 250-25G(2) to allow less of a freestanding sign setback than required (10 feet required, 6 feet proposed). PLEASE TAKE FURTHER NOTICE that, in connection with the Application, Applicant also seeks any additional exceptions, waivers, design waivers, variances, interpretations, de minimis exceptions, modifications of conditions of prior approvals, continuation of any preexisting nonconforming conditions, and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) as may be determined to be necessary during the review and processing of the Application by the Board and its professional staff. PLEASE TAKE FURTHER NOTICE that, pursuant to the declarations by the Governor of the State of New Jersey [Executive Orders 103 and 107], and the mechanisms that have been used by local governments during emergencies that render in-person meetings less than optimal, the public hearing will be held by online/virtual means and/or telephonically only. Anyone not on video will not be permitted to testify. The Land Development Board is composed of 9 members and 2 alternates.
