Here are the details about the "Clean Slate Act" that Governor JB Pritzker just signed into law. This is a great thing for the community at large. Understand though that this is not an immediate process.
About the Clean Slate Act (HB 1836)
The Act, signed on January 16, 2026, makes Illinois the 13th state to implement an automated record-sealing program.
Key Provisions:
Automated Sealing: The law automates the sealing process for convictions and non-conviction records that were already eligible for sealing via a petition-based process under prior law. This removes the need for individuals to navigate a complicated and often costly court process themselves.
Eligibility: After a waiting period (two years for misdemeanors, three years for felonies) from the completion of their sentence, records for qualifying offenses will be automatically sealed, provided the individual has remained crime-free.
Ineligible Offenses: The law does not apply to serious or violent crimes, including:
Murder
S*x offenses
DUI (driving under the influence)
Domestic battery
Class X and other violent crimes
Access to Records: Once sealed, private entities such as most employers and landlords will not have access to these records during background checks. However, law enforcement agencies, prosecutors, courts, and certain state licensing agencies will retain full access.
Implementation: The automated system will be implemented by the Illinois State Police and circuit courts over the next several years, with initial record sealing slated to begin by January 1, 2030.
