On Wednesday, the U.S. Court of Appeals for the Ninth Circuit vacated a $350 million settlement over throttling iPhones but reaffirmed its position upholding the use of incentive awards granted to lead plaintiffs.

Important win in the First Circuit.

We’re gratified that our amicus helped the First Circuit write an excellent opinion. The opinion establishes an important precedent that class counsel has a duty of candor in making fee requests. The First Circuit is correct that Judge Wolf was generous to class counsel given the magnitude of the wrongdoing. And the pay-for-play and scheme to increase fees by millions of dollars at the expense of the class is not unique to this case; we have an appeal pending in the Seventh Circuit with similar issues. Pension funds and state AGs should retain experienced objectors’ counsel to investigate more fee requests.

A prominent plaintiffs' law firm on Wednesday lost an appeal of sanctions it received after a judge found it and other firms behind a $300 million class action settlement with State Street Corp engaged in misconduct while pursuing fees.

Conagra Brands Inc. and Wesson Oil consumers must rework a false-ad deal after an $8 million class settlement that included nearly $7 million in attorneys’ fees was rejected by a federal district court in California after a renewed look.

A victory for attorney Adam Schulman, who successfully argued against Supreme Court appellate advocate Ted Boutrous.

The 9th U.S. Circuit Court of Appeals sided with an objector and threw out a $10 million settlement and about $2.6 million in attorneys’ fees on Wednesday in a class action against Massage Envy after finding the deal required more scrutiny under the Class Action Fairness Act.
