On July 23rd, the Trump Administration posted two interim final rules transferring “sound suppressors for non-automatic and semi-automatic firearms” from State Department jurisdiction to the Commerce Department, effective November 20th.

The change marks a major step toward allowing American hunters to travel abroad with their suppressors and giving American businesses access to established international commercial markets.

ASA has led the charge to legalize commercial suppressor exports for more than a decade. We’ll continue working with the Administration to clarify that all commercially available suppressors are eligible under the new rules, and keep you posted.

The federal district court’s decision in Jensen v. ATF created a significant opportunity for suppressor dealers.

Join ASA and TSRA with one dual membership. Membership positions your dealership within the current scope of the Jensen v. ATF ruling, allowing eligible suppressor transfers to be processed on a 4473 rather than a Form 4, subject to the court’s order and applicable law.

What You Need to Know
The ruling:
- Applies only to the named plaintiffs and the organizational plaintiffs’ members and customers.
- Does not eliminate the NFA.
- Dealers must have an SOT
- Dealers should continue following current law and should consult with their legal counsel prior to changing how they process NFA transfers.
- Dealers must be located in one of the 27 qualifying states and not in one of the 15 states with a statute that references the NFA or federal law.

This Is Just the Beginning.

At 1:30 PM CT, the court will hear oral arguments during the summary judgment hearing in Brown v. ATF before the U.S. District Court for the Eastern District of Missouri.

Following Congress’s elimination of the NFA tax on suppressors through the One Big Beautiful Bill Act, this lawsuit argues that the NFA’s registration regime can no longer be justified under Congress’s taxing power. It also challenges the NFA’s registration requirements for suppressors and short-barreled rifles under the Second Amendment.

The lawsuit was filed by the ASA, NRA, Second Amendment Foundation , FPC Action Foundation, Prime Protection STL, and two members of the organizations.

Stay tuned for updates as today’s hearing unfolds.
