Mrs. Pahira, on behalf of the trucking industry, please accept our condolences on the loss of your son Michael.

I am a former police officer and motor carrier investigator in New York. I now run the Small Business in Transportation Coalition as Executive Director.

SBTC aka Truckers.com is suing to decertify states giving commercial driver’s licenses to illegal immigrants like the trucker who killed your son. We filed suit in June... sadly, not in time to save Michael... but hopefully we will save future lives. We just wanted you to know we are not going to stand idly by as families like yours suffer needless tragic losses.

May time ease your pain and may Michael rest in Eternal Light.

We believe the TIA is the most dangerous organization fighting against independent truckers and small business carriers in the industry. We believe their ethics code is a complete sham as they failed to respond to our 2023 ethics complaint against . Indeed, we believe Chris Burroughs is as corrupt as they come.

As far as we are concerned, bad public policy by buying politicians through their PAC as henchmen for .

TIA is against independent truckers on issues from broker rate transparency to asking to create a DO NOT USE list of duly licensed and active motor carriers with operating authority, which would be a DEATH WARRANT for carriers without a SATISFACTORY safety rating.

We are zealously standing up to TIA when no other so-called trucker advocacy group has the ability or guts. Our pushback is reported on here:

SBTC filed the first petition to strengthen broker transparency. then followed us. We defeated TIA's attempts to repeal the 49 CFR 371.3 transparency rule.

SBTC Board Member Dakota Springfields of Express is leading the broker transparency charge in the Court of Appeals.

SBTC is the main trucker-side force standing in between you and the unemployment line, preventing your exploitation and the complete destruction of YOUR business.

BREAKING NEWS FROM PINK CHEETAH EXPRESS

The Pink Cheetah Express v. TQL broker transparency appellate case has been set for oral argument before the U.S. Court of Appeals for the D.C. Circuit on September 11th, 2026 at 9:30 am.

Before the Three Judge Panel Court, is the issue of whether the District Court Judge erred in determining a November 30th, 2023 written directive from FMCSA does not constitute an enforceable "order" under 49 U.S. Code § 14704 by using a standard dictionary definition of the term "order" rather than the Administrative Procedure Act definition asserted by the Plaintiff.

Pink Cheetah Express is asking the Court of Appeals to reverse the District Court's dismissal and remand the case back down for adjudication on the merits.

In the original complaint, Pink Cheetah Express, after filing a complaint to then-Secretary Pete Buttigieg under 49 U.S. Code § 14701(b), sought enforcement of the Secretary’s order to TQL to remove the 49 CFR 371.3 waiver language from all of its broker-carrier contracts with carriers as a matter of the waiver having been disallowed by FMCSA in furtherance of the Federal Evasion of Regulation statute (49 U.S.C. § 14906), and to comply with broker rate transparency requests from all carriers moving forward.

The trial court judge determined the directive was "workaday guidance" rather than an "order."

TQL in its Appellee brief argues the directive to remove the waiver and comply with 371.3 requests was mere advice and not an enforceable order.

The Court of Appeals will issue a formal decision on the matter after the September hearing.
