The expansion of Father Bill's Mainspring house at the site of the Carleton House is not appropriate. Brockton has done it's share and the precedent of adding 31 apts in a I3 Zone is disconcerting.

ATTENTION WARD 3 RESIDENTS

Father Bill's Mainspring will be holding a public meeting on April 30 th. at 7:00pm. The meeting location is at 460 Belmont St.

They are proposing 31 additional units of permanent housing at the Roadway Inn (Carlton House).

Do we need 31 units of additional housing at this location? Please join me and express your questions or concerns at this meeting. Please share this information with all your neighbors. .

Looks like Timeless Antiques people have listed their properties again as COMMERCIAL Real Estate again for $1,699,000. The listing has the following disclosure:

Disclosures/Rstr.: Sale includes 149 Mill Street currently leased to a real estate company. Buyers and buyer's agents to do due diligence on permitted uses under C-5 Zoning and special permitting uses, legal use, and conforming and non-conforming uses.

We can perminantly stop Timelesss Antiques from building an Apartment Complex in our neighboirhood.

It is time for Brockton to join the majority of Massachusetts Cities and Towns by amending our Zoning Ordinances to eliminate the Zoning Board of Appeals authority to rule on Use Variances. We need an Ordinace change to remove "including variances for uses not otherwise permitted in the district in which the land or structure is located."

Current Zoning Ordinance

Sec. 27-48. - Appeals.
1.The board shall hear and decide appeals from and review any order, requirement or decision made by the inspector of buildings in the enforcement of this chapter including variances for uses not otherwise permitted in the district in which the land or structure is located.

Proposed Zoning Ordinace would read as follows after revision.

Only 5 of the 39 Cities and 312 Towns in the Commonwealth allow a Business or property owner like Timeless Antiques to circumvent Zoning Ordinances through the Zoning Board of Appeals. This is the equivilent of Spot Zoning since one property owner is given an advantage over others in the same class.

We, the Residents of Brockton deserve the same protections from Business encroachment into our neighborhoods as the majority of Massachusetts Residents. Under MGL 40A Use variances are illegal unless authorized by a City or towns Zoning Ordinance.

Call your City Councilor and ask them to change the Zoning Laws to eliminate Use Variances.

99% of ZBA Petitions we have fought since I've lived in Brockton would not happen in other communities. Brockton is 1 of 5 Cities or towns that allow Use Variances to be heard by the ZBA. In all other Communites a vote by 2/3 majority of City Council after a series of hearings is needed for a Zoning Change to be made. Is it time for Brockton to join the majority of Massachussets and remove Use Variances as a purview of the ZBA? We deserve better.

MGL 40 A SECTION !0 VARIANCES.. Except where local ordinances or by-laws shall expressly permit variances for use, no variance may authorize a use or activity not otherwise permitted in the district in which the land or structure is located; provided however, that such variances properly granted prior to January first, nineteen hundred and seventy-six but limited in time, may be extended on the same terms and conditions that were in effect for such variance upon said effective date.

Marshall Corner Neighborhood United was established by Brockton Residents impacted by Coffman Development Group’s proposal to Rezone 6 Residences to Office/Commercial in order to build a ConveniantMD on Marshall Corner at the intersection of Stonehill Street and Pearl Street. We are a City Counselor at Large, a BU Professor, a Retired Program Development Development for the Commonwealth of Massachusetts, a Minister, a Real Estate Agent, a School Committee Member and many others who came to this area to raise our families. This is a diverse community that likes the quiet and convenience we find,
