⚠️ Yesterday the State Water Board released a new draft of the Proposed Water Right for the Sites Reservoir. Not only are they proposing to let the Sites Authority to take almost 1 million acre feet of water a year, and flood sacred sites, they gutted several key provisions from the draft. The draft, while far from perfect came out after two years of hearings and attempted to protect other water right uses and water quality.
👉 Comments are due in 30 days and a hearing will happen on November 4th.

Laws related to public comment periods and how communities and non-profits can engage are changing. On the federal level more decisions can be made now without public comment than in the past. All public comment periods are open to all; however, commenting is not lobbying. There is misinformation going around on this and we are getting a lot of questions.

Let's be clear: engaging in public hearings and comment periods is not lobbying, and peaceful demonstrations at public hearings are legal and fundable (sometimes a permit may be required, depending on location).
Lobbying is also legal, but there are clear rules for what lobbying is, who can lobby, and how to report it.

These are hard times. Do not let anyone convince you that engaging in public comment makes you a specific interest or radical. It is our right and responsibility to engage in the decisions that impact us and it does make a difference. We may not always agree but everyone has the right to speak out on public processes.

This year marks the 10 year anniversary of Native American led resistance to the Dakota Access Pipeline (DAPL) at Standing Rock. This movement led to the modern day water protection movement, and It is ongoing.

All month long, we will highlight not only the history of the movement at Standing Rock, but also the ongoing work of the Tribes, activists, lawyers, artists, orgs, and others who made It happen, and continue the fight.
The and
groups like , Civil Liberties Defence Council, and are still fighting DAPL and for the water protectors that were impacted and they deserve our support.

The Standing Rock Sioux Tribe and groups like Water Protector Legal Collective Civil Liberties Defence Council Earthjustice and Indigenous Environmental Network are still fighting DAPL and for those who were arrested, and deserve our support.
