Jeremy Kalicum and Eris Nyx, founders of the Drug User Liberation Front (DULF), were convicted of drug trafficking after Vancouver police raided the group in 2023.

The pair argued their work was intended to reduce the risks of toxic street drugs by providing members with tested substances.

B.C. Supreme Court Justice Catherine Murray has now stayed their trafficking convictions and ruled that parts of Canada’s drug laws are unconstitutional in this context. The declaration of invalidity is suspended for six months to give Parliament time to respond.

The decision could have broader implications for discussions around safer supply, harm reduction and Canada’s response to the toxic drug crisis.

For people across Vancouver and Surrey, this is another major development in a crisis that has affected communities throughout the region.

I also want to echo what colleague and ally Stephen Murray said in the plenary of yesterday's State SUD conference. Stephen stated that as an EMT he had responded to far too many overdoses, where he was working on a person, or the person was dead, and there was Naloxone present. Naloxone does not help if there's no one there to administer it. Remember not to use alone. People care. You matter.
