Tomorrow, the Michigan Court of Appeals will hear oral arguments challenging the Michigan Public Service Commission’s (MPSC) permit to construct a tunnel under the Straits of Mackinac for Enbridge’s Line 5 pipeline. If upheld, the decision could extend Line 5’s operations by another 99 years, threatening the waters of the Great Lakes and Indigenous treaty rights.
This case stems from the MPSC’s approval of the permit in December 2023, which the appellants argue was based on an incomplete and biased record favoring Enbridge. The appeal represents years of legal resistance from environmental groups, tribal nations, and allied organizations.
