Discovery For Justice

Discovery For Justice Discovery For Justice is a coalition that advocates for improvements in the law, the legal system, and the administration of justice.

The Problem:

In New York State it is legal practice to withhold information pertinent to criminal cases from a defendant and his defense attorney until the very moment of trial. This is not because the information is unavailable; it is because the prosecution does not have to turn over such information earlier. For example, prosecutors are not required by law to hand over police reports, prior te

stimony, and any other evidence to the defendant until trial begins, and in some cases, not until the first witness takes the stand. A prosecutor does not even have to turn over evidence that might help a defendant or cast doubt on his guilt unless the prosecutor thinks it is important. This practice costs both taxpayers and the judicial system a great deal of time and money. The Solution:

We request that New York State Senate Bill Number: S4089-2013 gets voted out of the Senate Standing Committee on Codes as new Criminal Procedure Law Article 245, thereby repealing CPL 240. As a result, CPL Article 245 would require that both the prosecutor and defense attorney provide the opposing party with extensive discovery early in a criminal case. In addition, CPL Article 245 would include a mechanism for prosecutors with legitimate concerns about the safety of their witnesses or with on-going investigations to withhold or redact any evidence or information covered by the statute and to move for a protective order.

Dear Families,

6/7 Guidance for New Yorkers

All New Yorkers should limit outdoor activity. People with heart or breathing problems and children and older adults may be especially sensitive and should avoid outdoor activities.
If you are an older adult or have heart or breathing problems and need to be outside, wearing a high quality mask (e.g. N95 or KN95) may be helpful.
Conditions are expected to change throughout the day and worsen tomorrow afternoon and evening. Recommendations may change based on monitoring of air quality conditions.

Schools are open, but cancelled all outside events. Air quality will begin to deteriorate again this afternoon and evening. Tonight may be worse than the last. Smoke is not anticipated to clear as much tonight night, so we may see very poor air quality through Thursday afternoon.

Bail, Discovery, and Raise the Age are Under Attack

As you know, the New York State budget is due tomorrow and Governor Hochul is pushing to include alarming roll backs to bail reform, discovery reform, and Raise the Age. If enacted, these proposals will incarcerate even more New Yorkers, perpetuating mass incarceration and racial disparities in the criminal legal system. We must stop Hochul's incarceration plan! Take action here to tell lawmakers: No rollbacks!

The data is clear, these reforms are working to increase safety and justice in New York. A recent analysis by the Data Collaborative for Justice at John Jay College confirms our fears: Hochul's incarceration plan will increase the number of people jailed pretrial, while exacerbating racial disparities in the criminal legal system. Yesterday, news broke that legislative leaders are considering enacting parts of Hochul's incarceration plan. This is outrageous, but still we have a chance to stop them: Take 2 minutes now to protect bail, discovery, and Raise the Age.

Katal and Dozens of Groups Rallied in Albany to Reject Hochul's Incarceration Plan, 3.28.22
On Monday, we joined dozens of community groups in Albany for a rally to demand lawmakers protect bail, discovery, and Raise the Age (see highlights here). We also did legislator drop-in’s where our members and volunteers spoke with Senators and Assemblymembers about the need to protect these reforms. You can do the same right now by Telling Albany: Reject Hochul's incarceration plan! No rollbacks!

If we take action together now, we can stop Hochul's incarceration plan. Take action now and share it with your colleagues, members, and networks.

Governor Hochul proposes a public safety plan that will lead to more New Yorkers being incarcerated pretrial. Take action here to tell your lawmakers: DO NOT roll back bail reform, discovery reform, or Raise the Age: https://secure.everyaction.com/71KNeEszCEmLrVzgSzDIWg2

“We think it’s important that policy making follows facts rather than fear.” NYC Comptroller Brad Lander speaking truth to power in a new US News/ AP op-ed. Despite intense fear-mongering to increase incarceration, a report from the Comptroller’s office found that the number and percentage of people in the city rearrested while on pretrial release were LOWER two years post-reform than they were a year prior to the changes.

This is serious. More people will end up in Rikers—which is currently understaffed and in a full-blown human rights crisis—for trivial, nonviolent offenses like jumping the turnstile in the subway. This will disproportionately impact low-income Black and Brown New Yorkers, who are more likely to be profiled by police and less likely to be able to afford bail.

Read the full op-ed on and contact your state representatives to let them know we cannot allow this to happen!
