Talking Christmas trees with the "tech bros."

Is TBPN our typical audience? Maybe not. But they asked some good questions.

NCTA Executive Director Rick Dungey recently joined Technology Business Programming Network (TBPN) for a livestream conversation about the Christmas tree industry. By the end of the discussion, the hosts were encouraging their followers to buy a REAL Christmas tree this year.

They also asked about NCTA's role in providing a real Christmas tree to the White House, which gave Rick a good opportunity to talk about the difference between a farm-grown real tree and imported artificial trees.

Canadian Tariff Clarification

We want to provide some clarification on the exact HTS codes being used for Christmas trees, wreaths and greenery imported from Canadian suppliers.

We have heard that some import brokers are using a code from the 9505 group for wreaths, which is subject to the new tariff, while others are using the 0604 group.

Here are the important distinctions for U.S.-based importers:

• Whole cut Christmas trees for retail sale:
0604.20.0020
0604.20.0040
0604.20.0060

These are NOT subject to the new Section 338 tariff.

• Fresh conifer greenery/foliage used for wreaths, porch pots, swag and similar products:
0604.20.0086

This is NOT subject to the new Section 338 tariff.

• Fresh wreaths made from fresh evergreen material and ready for retail sale:
If properly classified within the 0604.20.00 group, typically 0604.20.0086, they likewise are NOT subject to the new Section 338 tariff.

More complex or treated wreaths should be reviewed individually because classification can change based on the materials and processing involved.

• Dried or bleached foliage and branches, and other foliage that is not fresh:
0604.90.30
0604.90.60

These ARE subject to the additional 50% Section 338 tariff.

Canadian-grown fresh Christmas trees and fresh Fraser/Balsam greenery are not currently caught in the 50% Section 338 tariff, assuming they are entered under the appropriate 0604.20 classification. The products affected are primarily processed or non-fresh greenery categories specifically listed in the tariff action.

Natural U.S.-grown Christmas trees and fresh greenery are also not currently included on Canada’s counter-tariff list.

For specific product classification or tariff-line questions, your customs broker should be your first point of contact. CBP has final authority regarding the classification of imported merchandise.

New Adverse Effect Wage Rates (AEWRs) are now in effect.

The Department of Labor’s Employment and Training Administration published the updated rates on August 3. For most states, the new rates took effect immediately.

Because of the 2024 lawsuit involving the Farmworker Protection Rule, a two-week lead-time rule remained in effect for Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, Tennessee, Texas, and Virginia. The new rates for those states took effect August 17.

The national average AEWR was also recalculated using Skill 1 and Skill 2 45-2092 wages, without the HUD adjustment, lowering the average from $17.74 to $15.96. That figure is used to calculate H-2ALC surety bonds and is expected to result in approximately 10% savings for affected employers and contractors.

AmericanHort has finalized a one-page overview of H.R. 9535, the Securing Agriculture’s Workforce Act.

The document was developed by AmericanHort members and staff for members and the broader industry, and NCTA encourages growers, state and regional associations, suppliers, customers, and others connected to agriculture to review and share it.

Fake trees swing and miss again.

Background: The USTR rejected the request for an exemption for Section 301 tariffs back in early July. At the time we said:

"Artificial trees will remain subject to those tariffs, helping maintain a more level playing field for U.S. Christmas tree growers.

One tariff authority down, just the China Board to go. Another entity known as the “U.S.-China Board of Trade” was recently created to, according to the USTR website:
… optimize bilateral trade in non-sensitive products and deliver results for American farmers, ranchers, fisherman, small businesses, manufacturers, and workers."

Well, that entity just published the two countries approved initial lists of products for potential tariff reductions, and the main artificial Christmas tree HTS Codes ARE NOT included on the U.S. list.

The list does include several Christmas-related goods, including glass and wooden ornaments, nativity scenes, and certain Christmas-tree lights. This shows that Christmas merchandise was under consideration and gives us reason to believe our coordinated outreach with the membership helped communicate the concerns of domestic Christmas tree growers. While we cannot confirm how individual inclusion decisions were made, this is an encouraging initial outcome.

One thing to keep in mind is that this is an initial list. The framework allows additional products to be considered in the future, so maintaining this outcome will require continued attention. The announcement also does not itself change tariff rates; reductions and implementation dates remain to be determined.

Shameless plug time:

Not to put too fine a point on it, but NCTA pays for this effort to monitor and take action on issues like this through the "Advocacy and Protection" pieces of the budget. That is funded by members who pay a voluntary extra amount on top of their dues, and state/regional associations who pay $25/ member to fund National Advocacy & Protection Program. That's it...$25 bucks. Less than 1 tree per year.

Are you a member of NCTA? If not, is your state/regional association participating in the NAPP program?

NCTA is one of more than 200 agriculture organizations that signed a coalition letter to Senate Agriculture Committee Chairman John Boozman and Ranking Member Amy Klobuchar urging bipartisan passage of the Agricultural Act of 2026.

The letter points to the significant pressures facing U.S. agriculture and the need to move a Farm Bill forward to provide greater certainty and support for America’s farmers and ranchers.

This coalition letter reflects broad support across food and agriculture, and NCTA continues to encourage organizations to send their own letters of support and engage with members of the Senate Agriculture Committee.
