Appeals court denies VA’s request to reinstate termination of AFGE NVAC contract pending appeal.

At 6:30pm today, VACO-LMR provided a memoranda to the National VA Council concerning the Department’s implementation of the preliminary injunction restoring our Master Agreement. It appears that VACO is finally providing guidance and instructing facilities to take immediate steps to comply with the court’s orders.

VA Central Office is instructing facilities to return to the status quo for all AFGE-represented employees. This includes EVERYONE covered by the Master Agreement before the August 6, 2025 Termination.

GRANTED: NVAC’s Motion to Enforce Preliminary Injunction was granted this morning in the U.S. District Court for the District of Rhode Island.

Today’s hearing confirmed that despite the VA’s unlawful actions, collective bargaining must be reinstated. The VA must comply.

During the hearing for our motion to enforce the preliminary injunction, Judge DuBose gave the VA until Tuesday to explain how its actions could be interpreted as anything other than contempt of court. Their refusal to implement the Court's order and their illegal re-termination of the contract are blatant disrespect not only for the Court's order but also for the law.

The National VA Council extends our deepest gratitude to all our members and leaders who provided evidence of the VA’s non-compliance. Those who have stayed with and joined our union are the reason we continue to win victories like today.

A Federal District Court Judge has ordered VA to reinstate our Master Collective Bargaining Agreement! We celebrate this victory, but it is not the end of the fight. This is a preliminary injunction and not a final decision. The VA is expected to appeal and to seek an emergency stay of this decision. We are in a long battle for our collective bargaining rights and we will prevail in the end through our Unity and perseverance!
