We’ve been waiting for this day for almost 3 years!!! After an extensive collaborative rulemaking process, the updated Washington Administrative Code “rules” for highly capable programs were finalized on May 6, 2026.

This gives districts the detailed rules for how to implement the 2023 highly capable law, including:

- New definitions for highly capable students, twice exceptional students, objective & subjective criteria, accelerated learning & enhanced instruction…

- Universal screening details, including requiring at least two objective data points before making any decision

- Prioritizing identification of historically underrepresented groups through local norms, careful use of tests, and professional judgment

- So much more!

We will share more details over the coming days and weeks, stay tuned!

It's hard to express how exciting it is to see this final step happen! THANK YOU to each and every person who contributed to updating the WAC and to each step of the rule making process.

We did it!
