Today, I was alternately moved, shocked, saddened and enraged listening to the attorney for the State Dept arguing that although my friend and colleague Dana Zzyym was born inters*x and they acknowledge that Dana is not male or female by the standard definitions of either, they should say they are either male or female--either, mind you- because having only male or female is "the way it's always been." The fact that Dana is a Navy veteran who fought three tours of duty to uphold the rights granted by the constitution of this country only makes it more insulting that they are being denied their constitutional right to leave and re-enter this country unless they lie on a federal document.

Why do they want Dana to lie, when it is a felony to do so? Because they do not want to accept inters*x people into society.

I'm so grateful to and proud of Dana for standing up to them, as I see the pain that having federal attorneys say that you should disappear induces. I'm also eternally grateful for the excellent staff at Lambda Legal who are fighting for our right to be acknowledged and accepted for who we are: born inters*x and identifying as inters*x and non-binary.
