NLRB DEMANDS REPUBLIC SERVICES/BROWNING-FERRIS BARGAIN WITH TEAMSTERS LOCAL 350⁣

Board’s Decision Ends Landmark Joint Employer Dispute after Lengthy Battle⁣

(OAKLAND, CA.) – The National Labor Relations Board (NLRB) has ended a lengthy joint employer dispute between the multibillion-dollar waste giant Republic Services and Teamsters Local 350, ruling in the union’s favor. ⁣

Over a decade ago, 200 workers at Republic Services — at the time doing business as Browning Ferris — voted to join Local 350. Republic falsely claimed the workers were employed by a third-party staffing agency, Leadpoint Business Services, and refused repeated offers to recognize the group’s union. The NLRB ruling definitively mandates that Republic must negotiate with Local 350 as the unit’s bargaining representative.⁣

“This win is a major milestone that will be remembered for decades as one of our union’s many contributions to the collective fight for workers’ rights. And it only happened because of the unity and resilience of these workers—who are finally, officially Teamsters,” said Robert Sandoval, Secretary-Treasurer of Local 350. “Teamsters always say one day longer is one day stronger. This unit exemplified that, never losing sight of victory.” ⁣

Corporations often resist being labeled as a “joint employer” as a form of union busting. They do this to dodge their responsibility to bargain with workers by using “third-party” companies to fill positions. Republic employed this tactic at the Milpitas, CA, facility despite maintaining total operational control over the workplace.⁣

“Republic Services is one of the nastiest companies in America. They blew hundreds of thousands of dollars and dragged out this fight as long as possible, all in a failed attempt to deny workers their rights,” said Victor Mineros, Director of the Teamsters Solid Waste & Recycling Division. “We are grateful to the NLRB for forcing this multibillion-dollar corporation to comply with the law. The Teamsters look forward to providing these workers the strong representation and support they want and deserve as they bargain their first contract.”⁣

Earlier today, Teamsters Local 350 members were out in San Jose’s District 5 engaging with voters and spreading the word about our endorsed candidate, Councilmember Peter Ortiz.

It was great spending time in the community and talking with residents about the importance of supporting leaders who stand with working families and organized labor.

A huge thank you to all of our incredible shop stewards who participated in this year’s steward seminar. The strength of our union starts with educated, engaged, and active stewards who are willing to step up, represent their coworkers, and be leaders on the job every single day.

From handling workplace issues, enforcing the contract, protecting members’ rights, and serving as the first line of communication between the membership and the Local, the role of a steward is critical to the success and strength of our union. Knowledge truly is power, and it was great to see the level of participation, discussion, and engagement throughout the seminar.

Workers at Recology San Mateo Ratify Strong Contract Strengthening Healthcare Benefits and Worker Protections⁣

(SAN MATEO, CALIF.) — This week over 140 workers in the Recology San Mateo sanitation drivers unit represented by Teamsters Local 350, overwhelmingly voted to ratify a new five-year contract with the waste hauling company.⁣

The ratified agreement with Recology is one of the strongest in the country. The contract delivers dozens of improved provisions for workers including increased retirement benefits, a 25 percent wage increase over the life of the agreement, codifies language for additional economic opportunities throughout and improves important protections for workers against constant surveillance of employees by drive cameras in and around the trucks. ⁣

“In January, the workers in the unit unanimously voted to authorize a strike, if necessary, to force the company to come to the bargaining table after months of delay and disrespectful proposals,” said Robert Sandoval, Teamsters Local 350 Secretary-Treasurer. “We said there would be no concessions and with the unified voice of the workers over the last five months of negotiations, they brought this over the finish line and proved to the Recology that we would not back down until a strong agreement was delivered elevating the standard within the waste industry.”⁣

Sanitation Drivers in the unit cover hundreds of commercial and residential routes collecting waste, recycling and compost serving the cities of Belmont, Burlingame, East Palo Alto, Foster City, Menlo Park, Redwood City, San Carlos, and San Mateo, the town of Hillsborough, the County of San Mateo including unincorporated San Mateo County and part of the West Bay Sanitary District.⁣

“This is a critical win for everyone in the unit,” said Brian Marshall, Sanitation Driver in the unit and bargaining committee member. “Securing a strong contract like this makes all the difference in the world for the health and safety of me and my brothers on the job. We clock-in to work every day ensuring our communities stay clean and healthy, we deserve the same respect delivered in this agreement.”⁣
