The legal gateways and guardrails for checking in with employees about mental health can sometimes feel like a minefield, and HR professionals are often the ones their organizations rely on to get it right.

This session will address the real-world challenges of managing mental health as a hidden disability, including employee reluctance to disclose, the blurred lines between performance issues and disability, and the stigma that complicates the conversation. Attendees will leave with practical strategies for:

- Distinguishing between permissible well-being check-ins and prohibited disability-related inquiries under the ADA
- Initiating and navigating the interactive process for mental health accommodations
- Recognizing when there is an objective basis for fitness-for-duty examinations
- Applying a “tolerate, test, or terminate” framework when employee conduct may signal a direct threat
