Abortion remains a significant legal, medical, & personal issue across the United States, & Utah is no exception. With changing laws & ongoing court cases, it can be difficult to understand what is currently allowed & what restrictions are in place.
Abortion is currently legal in Utah, but it is limited & regulated under state law. A near-total abortion ban was passed by the Utah Legislature & triggered after the overturning of Roe v. Wade in 2022. However, that law is currently blocked by the courts while legal challenges continue.
At this time:
• Abortion is permitted up to 18 weeks of pregnancy
• Court rulings have paused stricter laws that would significantly reduce access
This means individuals can still seek abortion services within the legal timeframe & under specific medical & legal requirements.
After 18 weeks gestation, abortion is generally not allowed unless certain exceptions apply. Exceptions include:
• Serious risk to the life / major bodily health of the mother
• Fetal conditions that are considered incompatible with life
• Pregnancy resulting from r**e / in**st
In cases involving r**e / in**st, Utah law generally requires that the incident be reported to law enforcement for the exception to apply.
