Justice Beyond the Courtroom fully supports AB 2727.

Is it everything we believe is necessary? No.
But it is a step in the right direction — and right now, any meaningful reform is better than what we currently have.

We believe many of these perpetrators should never be released. But that is not what current law allows. That is why we exist — to fight for victims and survivors, to bring common sense back to public safety, and to push for reforms that prioritize community safety.

AB 2727 moves us forward.
It strengthens accountability.
It centers safety.
And it proves that change happens one step at a time.

We stand with victims.
We stand for public safety.
We support AB 2727.

I am so proud to announce that today Assembly Bill 46 passed the Senate Public Safety Committee on a unanimous bipartisan vote! This bill strengthens judicial discretion in California’s mental health diversion program while preserving access to treatment and rehabilitation.

Justice Beyond the Courtroom stands in strong support of AB 46 — a critical step toward restoring balance, accountability, and public safety in California’s justice system. For too long, gaps in current law have limited the ability to fully assess risk and ensure appropriate outcomes. AB 46 changes that.

After more than a year of collaboration and thoughtful development, this bill introduces meaningful guardrails that prioritize both safety and fairness.

AB 46 ensures courts can evaluate:
• Whether a defendant poses a substantial and undue risk to the physical safety of others
• Whether a proposed treatment plan is clinically appropriate to address the mental health condition tied to the offense

This is about balance. This is about responsibility. And most importantly — this is about protecting our communities while still recognizing the role mental health plays in the justice system.

We support smart policy. We support safer communities. We support AB 46.

Justice Beyond the Courtroom is asking our community to speak up.

Gregory Vogelsang—sentenced to 355 years to life for molesting five boys between the ages of 5 and 11 in the 1990s—has been granted early release under “elder parole.”

An En Banc hearing to review this decision is scheduled for March 18, 2026 at 9:00 AM, and the public has the right to be heard.

Justice Beyond the Courtroom is encouraged by the California Senate Public Safety Committee’s decision to advance Assembly Bill 46, authored by Assemblymember Stephanie Nguyen. The bill would restore judicial discretion and ensure prosecutors have a voice in California’s Mental Health Diversion program, helping balance treatment with accountability and public safety.

Sacramento County DA Thien Ho Urges the California Legislature to Pass AB 46

The California Senate Public Safety Committee took a significant step in restoring balance in the justice system by advancing Assembly Bill 46.

Authored by Assemblymember Stephanie Nguyen, AB 46 would restore judicial discretion and give prosecutors a voice within the state’s Mental Health Diversion (MHD) program.

“I commend the California Senate Public Safety Committee for its thoughtful review of AB 46 and for advancing this critical public safety and mental health legislation,” said Sacramento County District Attorney Thien Ho. “I am also grateful to Assemblymember Stephanie Nguyen for authoring AB 46 and working closely with criminal justice and community organizations to balance mental‑health diversion laws by ensuring we provide treatment to those who need it while maintaining the safety of our communities.”
