Pinnacle Mountain Community Coalition PMCC is comprised of concerned citizens living in the Pinnacle Mountain area. This means Mill Bayou, a stagnant Bayou, will become a sewer pipe.

The PMCC's most immediate concern is the proposed large-scale, 1st phase, 76 tract home development for rural Roland Cutoff Road and the effects this will have on our community. Paradise Valley, the proposed urban development, will employ an above ground wastewater treatment plant that will discharge effluent (treated waste) into the communities, Mill Bayou. The sewage facility at maximum capaci

ty will discharge 50,000 gallons per day into an unnamed tributary (a small ditch) and then to Mill Bayou as it winds through homes and agricultural fields and areas with livestock as it makes its way to the Arkansas River. A second 50,000 sewage facility is planned as it reaches full build out of over 400 homes. If all planned developments go through all four phases. We will have 300 homes. The Pinnacle Mountain area is an irreplaceable treasure in the county and state. The Paradise Valley development will leap- frog into an area that has no infrastructure to support it, most notably for sewage, and its Treatment Plant will discharge treatment waste into our Mill Bayou turning it into a sewer conduit and is expected to bring vapors and hazardous algal blooms in contact with people and wildlife. Mill Bayou has both flooding and stagnation issues and there is concern the effluent will create an unhealthy environment through harmful algal blooms and vapors to an area that is surrounded by Lake Maumelle Watershed, Pinnacle Mountain State Park and the Quachita Trail. Even when treated, sewage effluent contains nutrients like phosphorus that can choke waterways with algae, deprive the water of oxygen and kill fish. Citizens are concerned that the development will pollute and degrade the area of one of the Pulaski County's most beloved natural landmarks.

Quorum Court UPDATE from Tuesday 5/26/26 meeting

Thanks to all who signed the PMCC circulated petition. We received over 140 signatures within 6 days which were sent directly to each Justice of the Peace ahead of their 6pm meeting 5/26 and representative of a majority of the 15 JP districts in Pulaski County.

The meeting began with an unscheduled panel of speakers organized by Judge Barry Hyde and was an "info-mercial" to the quorum court and the public on the subject of data centers, particularly the AVAIO data center planned near Wrightsville in unincorporated Sweet Home. The panel included Chamber of Commerce, Entergy, Central Arkansas Water, and AVAIO.

Here are results regarding the petition:

1. WIN: the court thankfully failed to pass the quarterly planning board meetings which would have been in addition to their monthly. PMCC pledges to continue to advocate for the Planning Board meeting time to change from the outdated 1948-set time of 2pm to a time later in the day for the working public to be able to attend. Stay tuned.

This ordinance required 10 votes to pass and received 9 = FAIL = WIN FOR THE VOTERS

Sponsors of the ordinance were: Justices Steven Person (district 5) , Natalie Capps (district 2), Patricia Young-Baker (district 10)

Here’s how the Quorum Court voted:

Voted in the public's interest (thank you): Rebekah Davis (district 1), Kathy Lewison (district 3), Julie Blackwood (district 4), Curtis Keith (district 8, Luke McCoy (district 12)

Voted in the interest of unelected bureaucrats; namely planning board commissioners and planning staff: Natalie Capps (district 2), Steven Person (district 5), Donna Massey (district 6), Dianne Curry (district 7), Tina Ward (district 9), Patricia Young-Baker (district 10), Phil Stowers (district 13), Paul Elliott (district 14), Staci Medlock (district 15)

Voted on the fence as "Present": Aaron Robinson (district 11)

2. NO ACTION TAKEN: No one made a motion to recall the data center resolutions and ordinances sponsored by Justice Julie Blackwood (district 4) back from the planning board. Therefore the planning board will be leading the effort and hosting public hearings at dates and times to be announced regarding the data center land use regulations communities are calling for. It is unclear if staff will have outside experts guiding the process.

3. TEMPORARY SETBACK: a 12-month moratorium (pause) on data center application processing by Pulaski County sponsored by our Justices Rebekah Davis (district 1) and Tina Ward (district 9) FAILED for two observed reasons:

First: AN ATTORNEY GENERAL OPINION WAS SHARED BY THE COUNTY ATTORNEY LAST MINUTE at the meeting (there was no prior communication to our Justice Rebekah Davis the sponsor) which he said could cause the county to be sued. This flipped votes from "yes" to "no" as at least one Justice indicated this changed a planned "yes" to "no". Justice Davis had no time to research the opinion to refute it.

Second: There was also a last minute "grandfathering" amendment which was sponsored by Justice Phil Stowers (district 13) who stated he would vote for the moratorium if this was added. This amendment request came from an outside attorney group asking the county attorney that it be added PMCC has learned.

This amendment was approved by a majority of Justices upon warnings by the County Attorney who indicated the county is less likely to be sued if they added it. The amendment excluded the 2024 AVAIO submitted application for the data center near Wrightsville in the unincorporated community of Sweet Home. This was not a welcomed amendment and would not have helped the people of Sweet Home who will be living next to a data center the county kept under wraps for at least two years. This amendment is arguably unconstitutional according to comments made after the vote by Pulaski County Candidate for Judge Wendell Griffen (former circuit judge).

With or without the amendment, the moratorium could have paused future data center applications for 12 months.

This ordinance required 10 votes to pass and received 9 = FAIL = SETBACK FOR THE VOTERS

Sponsors of the moratorium we wanted passed (without the amendment): Rebekah Davis (district 1), Tina Ward (district 9)

Sponsor of the unwelcomed amendment: Phil Stowers (district 13)

The amendment was voted to be added by a majority of the court. Then they voted on the moratorium with the added amendment next.

Here’s the how the Quorum Court voted on the moratorium with the added amendment (it wasn't optimal, but we wanted it to pass to at least give a 12 month pause on future data center applications from being processed until land use regulations can be established):

Voted in a way that benefits data centers probably out of fear of being sued: Dianne Curry (district 7), Curtis Keith (district 8 ), Patricia Young-Baker (district 10), Aaron Robinson (district 11)

Voted on the fence as "Present": Tina Ward (district 9), Luke McCoy (district 12)

PETITION SIGNATURES NEEDED ASAP BEFORE TUESDAY, MAY 26TH!

The Quorum Court meets on Tuesday May 26th at 6PM, 201 South Broadway, 4th floor to discuss matters which will impact our community. We are asking them to take action on 3 items:

1) Pass needed Data Center land use regulations for Pulaski County.
2) Pass needed Data Center moratorium on Planning staff and board decisions regarding these facilities until land use regulations are adopted by the Quroum Court.
3) REJECT the Planning Board Meeting compromise and pledge to work with our JP Rebekah Davis (District 1) on finding a better time for the working public to attend their meetings and not try to appease unelected commissioners & staff who have dug in their heels on meeting at the outdated 2PM time rather than meeting later in the day at the request of the public.

1. SUPPORT 26-I-17 JP Rebekah Davis our JP is again sponsoring an ordinance to change Planning Board meetings to no earlier than 5:30pm after lengthy discussions last month to modify it to only impact the Planning Board and no other county board. This was due to a poorly written ordinance by the former county attorney.
2. REJECT 26-I-27 This is sponsored by 3 JPs Person, Capps, Young-Baker and is meant to be a substitute to what JP Davis would like to see for her constituents, namely transparency at all Planning Board meetings by making them more accessible to the public. The flawed 26-I-27 proposes quarterly meetings to discuss land use. This is unnecessary when the topic could easily be added to the regular monthly meetings of the planning board. It is meant as a compromise but FAILS TO SEE THE POINT: the public wants better access to the monthly Planning Board meetings. That is where all the action is: decisions are made that can forever change our communities. The quarterly meetings are just a bone thrown to the public to hope we will be happy with a meeting that occurs during a time we want. The Quorum JPs sponsoring this flawed ordinance seem to not understand what is discussed at planning board meetings. PLEASE SPEAK TO REJECT THIS FLAWED COMPROMISE.

Our Justice of the Peace District 1, Rebekah Davis, on behalf of we her constituents proposes to change the Pulaski County Planning Board meeting time from 2pm to no earlier than 5:30pm to better accommodate the public rather than bureaucrats and developers.

She has respectfully tried to encourage the planning board to consider a time change to after normal business hours which would better accommodate the public but received pushback from the planning board commissioners who have dug in their heels.

On Tuesday, April 14 at 6pm at the Quorum Court’s regular agenda meeting, she is sponsoring an ordinance to mandate the time change her constituents desire and wishes for it to be placed on the agenda.

If it passes, then it will be placed on the Quorum Court’s agenda for the month. It would go before this Quorum Court body again later in April at another public hearing for final passage. We will send another email if it clears this first hurdle informing of the second meeting required to pass it into law.

Please attend the April 14 meeting to ask the Quorum Court to pass JP Rebekah Davis’ ordinance to change the Planning Board meeting time to better accommodate the public!

You may simply say “I support Justice Rebekah Davis’ ordinance 26-I-17 to change the planning board time in order to better accommodate the public and encourage civic participation and engagement.”

Community wins in Court of Appeals…again!

Yesterday March 11, 2026 the Arkansas Court of Appeals handed down a favorable opinion for our community in the flooding lawsuit case and reversed and remanded it back to circuit court. This is the second time the Court of Appeals has been asked to review its decision. Pinnacle Mountain Community Coalition is again very pleased with the decision. PMCC CANDIDATE FORUM A SUCCESS

Thank you to candidates for Pulaski County judge who participated in our first candidate forum last night: Judge Wendell Griffen and Michael Rushin, their campaigns, and also to our Senator Mark Johnson and JP Rebekah Davis and Al Drinkwater our special guest speaker on data center and the community for attending. Regrettably, current County Judge Barry Hyde declined due to conflict in his schedule.
