ANJRPC just released this alert for concealed carry in New Jersey for the duration of the new appeal, the categories of place restrictions challenged in the lawsuit where gun owners can and cannot lawfully carry (NOTE: these are not complete lists) are as follows:



THIRD CIRCUIT AGREES TO
REHEAR “CARRY KILLER” APPEAL

December 12, 2025. Earlier this week, a middle-level federal appeals court agreed to rehear ANJRPC’s “carry killer” lawsuit, Siegel v. Platkin, in front of the full panel of all 14 judges. This move wipes away the terrible decision of a three-judge panel earlier this year, and essentially represents a “do-over” of the appeal. The appeal will be reargued on February 11, 2026.

This decision also reinstates the legal state of affairs that existed prior to the three-judge panel ruling. Until the full court rules, New Jerseyans will remain subject to the partial suspension of the carry killer law that went into effect in 2023 (see below for more details).

That means that for the duration of the new appeal, the categories of place restrictions challenged in the lawsuit where gun owners can and cannot lawfully carry (NOTE: these are not complete lists) are as follows:

PLACES WHERE GUN OWNERS CANNOT LAWFULLY CARRY (Note: not a complete list):

- Within 100 feet of a public gathering, demonstration, or event requiring a government permit;
- Zoos;
- Parks, beaches, recreational facilities or areas owned or controlled by a State, county or local government unit designated as a gun-free zone;
- Publicly owned or leased libraries or museums;
- Bars or restaurants where alcohol is served and any other sites or facilities where alcohol is sold for consumption on the premises;
- Entertainment facilities;
- Casinos and related facilities;
- Health care facilities.

PLACES WHERE GUN OWNERS CAN LAWFULLY CARRY (Note: not a complete list):

While the new appeal is unresolved, the carry-killer law is STILL BLOCKED for the following places (NOTE: not a complete list), where carry with a valid carry permit can take place:

- Vehicles
- Private property open to the public
- Public film locations.
Additionally, the lower court’s original ruling is also in effect (for the duration of the current appeal) regarding:
- Blocking the Insurance requirement
- Blocking certain permit procedures and requirements.

As noted above, carry rights as described are only impacted for the duration of the new appeal, and it is likely that the rules will change once new appeal is decided. ANJRPC will continue to aggressively defend right to carry throughout every stage of the case. Gun owners should exercise caution and take great care to stay informed of all developments in this case as they occur, since this situation remains subject to change at any moment.

Look around you Gun Peasants; don't you feel safer 7 years after NJ Gov. Murphy's yet-to-be-declared-unconstitutional MAG BAN went into full force & effect? He signed it into law in June of 2018 as the Anti's danced in the blood of victims of psychopaths. They either had to be sold out of state, destroyed, permanently pinned to a mere 10 rounds, OR turned-in to law enforcement (NONE were turned-in)! After-all, everyone knows "you don't need 15 rounds to kill a deer", and so the 10 round magazine became the law of the land on this date 7 years ago!

AS OF 12-10-18 CONTRABAND MAGS CAN'T BE DISPOSED OF!

You read that right! Any magazine that's over 10 rounds can't be shipped, destroyed, altered, transported to a Free State or thrown in the trash! They made all those "remedies" ILLEGAL TOO!

New gun owners pay attention, especially if you inherit 15 round (or greater capacity) magazines! If you still have them or have a friend or relative that does, congratulations you're a "Felon-in-waiting". What's that you ask? A simple house fire, smoke condition, first aid call, etc. can bring SCRUTINY of EXTREME PROPORTION upon you should your mags be left in plain view...

So how many widows or widowers in NJ have ammo cans their deceased spouse stored in a closet, attic or basement stuffed with what's now considered CONTRABAND? Who knows? Will any of NJ's 21 County Prosecutors actually PERSECUTE a surviving spouse over mags that carry a MANDATORY FINE & 18 MONTHS IMPRISONMENT PER MAG? Who knows?
