Good morning, Palm Aire!

Sorry it’s been a hot minute, but as we know well by now, the wheels of Justice move S L O W L Y.

Here’s the latest:

The lawsuit has moved forward with a partially agreed request to certify it as a class action, focusing on getting court orders that clarify and protect Palm Aire residents’ rights, and both sides will now present the judge with an agreed order and class notice so that Palm Aire residents can be formally included in the case.

The “partial” agreement means both sides agree to move the case forward as a class action focused on getting orders and declarations from the judge, but the plaintiffs are giving up not any of their other legal options if the judge wants a different kind of class or broader treatment of the case.

The next case management hearing is set for June 1, at 8:45 a.m.

We’ll share an update once the Plaintiffs give us some details from their meeting with their attorney.

Incidentally, the formal submission of affidavits was 1251. There were likely more, but inevitably some don’t post or get processed in time. That’s nearly 12% of the community.

Of course we all wanted to see even more, however, we should be VERY proud of your efforts and grateful to the notaries and volunteers that coordinated the effort. These affidavits came in against all odds in many cases. We still have some association boards that are less than cooperative, but you all persisted and you need to continue building coalitions.

First of all, happy Mother’s Day to all moms, aunties, “like a moms” etc. We see you. We are grateful for you.

Also, on this Sunday, we are reflecting on what peace means to us in our little corner of Pompano Beach.

As we sit here, looking at one of the many association pools around the community, we can hear a steady stream of cars moving through the neighborhood and moving around us on all the arteries that surround Palm Aire – McNab, Lyons Road, the Turnpike, Atlantic Boulevard, and Powerline Road. There is a lot of movement all around us, but for the moment this place is still a sanctuary… An oasis.

This sense of living in an oasis is top of mind as we remind you that the next hearing will be coming up soon, and we are expecting to present the fruit of all of your hard work organizing, signing, notarizing, and submitting those affidavits in support of our efforts.

We know we have far more supporters than even the many we were able to formalize with the affidavits in a short time.

We also know that buildable land is at a premium everywhere, but perhaps particularly in the Tri-County area. Furthermore, green space (the way we know it here with an enormous tree canopy and plenty of open space) is even more rare.

So…

Stand up for our community and fight for it everywhere you go, Palm Aire. This is your home. This is your investment. This is where your life happens. This is the place you return to to find peace at the end of the day.

Trees, wildlife, open space… These are the things that make this place such a gem. Do everything you can to keep it that way.

For those of you keeping track of the private GoFundMe fundraiser established by one of our supporters, Anne Bosworth, she made the latest payment to the attorney of $1200. She reports that there is a balance of $39.94 in the bank account where GoFundMe deposits donations.
To date, she has raised about $4275 there toward a first GoFundMe goal of $12,000.

Anne reports that some folks who are contributing a little bit every month to try and offset the cost of the attorney which will be significant soon enough because we have a hearing coming up in about two weeks weeks or so.

Many thanks to Anne and to everyone who has used their time, talents, and treasures to support this effort. While no amount of funding can ever repay the great debt we owe to the plaintiffs who have put so much into this lawsuit on our behalf, we should all really truly be thanking them for keeping our concerns top of mind in the community and holding a seat at the table for us moving forward.

Please don’t get sidetracked in conversations with naysayers and accusers. Just keep telling the story of our 1985 agreement keep the pressure on, Palm Aire. Remember that no part of this community is safe from development, until every part of this community is safe from development.

We prefer you to donate through the savepalmaire.com website, but Anne’s GoFundMe can be found here: https://gofund.me/8ddfdf84f
