The afternoon programming continued with two timely sessions at the Institute for Law and Technology’s 63rd Annual Conference on Intellectual Property Law.

At the luncheon presentation, Sari Mazzurco (SMU Dedman School of Law) delivered “AI, Artists, and Trademark Law,” addressing current disputes over AI-generated content “in the style of” well-known artists and how trademark law applies—or doesn’t—to artistic style in today’s evolving landscape.

Next, “The Dawn of a New Era in College Sports” featured Demi Williams Coles (Jackson Walker LLP) and James Carlos McFall (Foley & Lardner LLP), who discussed the shifting legal and structural landscape of college athletics and the implications for athletes, institutions, and the businesses around them.

Day 2 of the Institute for Law and Technology’s 63rd Annual Conference on Intellectual Property Law continued with another round of strong sessions across the prosecution and litigation tracks.

The Patent Prosecution Module picked up with “Harnessing AI for Patent Application Drafting,” where Shirley Fung and Vanessa Yazicigil (Akona IP PC) walked attendees through the practical use of AI-powered tools in patent drafting, from advantages and limitations to strategies for effective prompt engineering.

Clint Mehall (Davidson Kappel LLC) followed with “Appealing to the PTAB: Bypassing the Examiner May Be Best for Your Client,” sharing tactics for winning appeals and insights into how recent USPTO and PTAB developments are influencing prosecution strategy.

On the Patent Litigation Module, Hank Spuhler and Christopher Scharff (McAndrews, Held & Malloy) delivered “Recent Developments in Patent Damages,” a deep dive into Federal Circuit updates affecting reasonable royalties, apportionment, comparable licenses, survey evidence, and enhanced damages.

The morning continued with “The Dramatic Rise of NPE Litigation, Current Trends, and the Critical Role of Indemnities,” moderated by Kelly Ransom (Kelly Hart & Hallman). Panelists Ken Hobday (DK Hobday Consulting) and Julie Kirby (Fiserv) examined the sharp increase in NPE activity, emerging targeting trends, and how indemnity obligations are shaping litigation decision-making.

Day 2 of the Institute for Law and Technology’s 63rd Annual Conference on Intellectual Property Law is off to a fantastic start.

Here’s a look at just a sampling of this morning’s speakers and sessions across the Litigation and Prosecution modules:

We began with the Litigation Module and an interactive “Ask Me Anything – Litigator Edition,” moderated by Elise J. Selinger (Caterpillar Inc.). Panelists Justin S. Cohen (Holland & Knight LLP) and Christina Ondrick (Boies Schiller Flexner LLP) led a wide-ranging conversation on pre-filing diligence, discovery challenges, valuation and damages, and the expanding role of AI in litigation.

Next, “The Case For and Against Transparency in Litigation Funding” brought together Brian R. Michalek (Saul Ewing LLP), Natalie C. Parker (CAC Specialty), and L. Kirstine Rogers (Certum Group) for a balanced discussion on disclosure, ethics, fairness, and how funding structures shape strategy and access to justice.

Over in the Prosecution Module, Alan Herda presented “Building a Design Patent Addition to a Utility Patent House,” sharing practical insights on how design patents can enhance and reinforce utility-focused portfolios.

He was followed by David Combes (Barker Brettell LLP, Birmingham, UK), who delivered “Updates on European Patent Law,” covering notable EPO developments, including new approaches to claim construction and prior-art considerations under recent decisions.

The afternoon continued at the Institute for Law and Technology’s 63rd Annual Conference on Intellectual Property Law with a timely look at how AI is transforming the profession.

In “Lawyers Rewired: AI’s Challenge to How We Learn, Work, and Remember,” moderator Sarah Foley (Foley IP Law, PLLC, Dallas, TX) led a multidisciplinary conversation with Megan Carpenter (UNH Franklin Pierce School of Law), Ed Cavazos (Pillsbury Winthrop Shaw Pittman LLP), and Lisa George (Salesforce). The panel explored how AI is reshaping legal education and onboarding, redefining mentorship, and changing how institutional knowledge is created and retained across the industry.

Day 1 wrapped with a bit of competition and camaraderie at Intellectual Property Trivia, presented by the Young Lawyers Committee of the Dallas Bar Association’s IP Section and hosted by David Y. Ashton (Patterson + Sheridan, LLP) and Matt Cornelia (McGuireWoods LLP).

The afternoon kicked off strong at the Institute for Law and Technology’s 63rd Annual Conference on Intellectual Property Law with two engaging panel discussions.

The program resumed with “The Impact of the PTAB on the Patent System,” moderated by Ryan D. Gum (Senior Counsel, Chevron, Houston, TX). Panelists Sadaf R. Abdullah (Ericsson), Hon. Nate Engels (Former USPTO Administrative Patent Judge), and Jerry R. Selinger (Patterson + Sheridan, LLP) explored how PTAB proceedings continue to influence litigation strategy, innovation, and the broader patent landscape.
