The AZ Supreme Court unanimously ruled that destruction of a record sought through a public records request is a denial of access. ACLPI wrote a friend of the court brief in the case in which the justices ruled that courts, not government agencies, decide what must be produced under the public records law.

“It’s really the court’s role to police the government’s withholding of what qualifies as public records, and the extent to which a confidentiality interest that the government serves can outweigh the people’s right to see what the government’s up to,” said Nick Ansel, attorney for the Center.

The Center is representing the Save Sedona Committee in response to the City of Sedona’s lawsuit seeking to block a voter initiative from appearing on theballot.The initiative, supported by more than 1,400 Sedona residents, aims to preserve the SedonaCultural Park as public land for future generations.

The lawsuit filed by the City seeks to prevent the initiative from going before voters, despite meeting all legal requirements for ballot qualification. The Sedona Cultural Park property has long been the subject of community interest, with residents advocating for its preservation and the restoration of its amphitheater as a cultural andarts venue.
