Background:
A “Notice to Remedy” warns a tenured teacher of conduct that must be corrected to avoid dismissal and provides a chance to remediate before charges in support of dismissal are brought. SB 2914, which IEA supports, would require districts to follow due process when issuing a Notice to Remedy. Teachers would have the right to respond to the notice, either in person or in writing, before the school board makes a final decision on it. If a teacher disagrees with the board's final decision on the Notice of Remedy, the teacher could take the matter to binding arbitration. Currently, school boards have the authority to decide to issue a Notice without allowing teachers to refute or defend against charges. And, Notice to Remedy is not legally considered discipline, so our contracts do not allow us to file grievances related to them. Districts in our area have used the Notice to Remedy in situations where other less severe action could have been taken to address issues in discipline or performance, but we (members/locals) have limited ability to change the issuance or outcome when there is no requirement for due process.
CALL TO ACTION: Our Notice to Remedy Bill has been posted to House Committee! We need your help! School management is opposing this bill and has done a call to action having their members file witness slips opposing the bill. We need you to create a witness slip as a PROPONENT to support this bill. SB 2914 gives teachers the right to due process when issued a Notice of Remedial Warning.
If you are an educator, please do not do this on duty time or on district devices.
Here are the steps to filling out a witness slip:

Fill out the information for the witness slip including your name, address, etc. It will ask for the “firm/agency” you represent and your title. You do not have to put anything specific in those fields, but you will need to put “NA” in order to submit the slip (If you would like to put your local association and “member” or your local leadership position in those fields, you certainly can do that)
In the “representation” section, you can again put your local association
In the “position” section, select “original bill” in the drop down under “add legislation” and you will select “PROPONENT” under position. You will then have to click “add position”. You will see your position added to the box on the right side of the screen.
In the “testimony” section, you will select “Record of Appearance Only”
You then click to agree to the terms and submit the witness slip!
