The Oxford Ligation Office here at North Mississippi Rural Legal Services is starting an outreach campaign. This year’s campaign focus is on expungements. We are trying to reach out to multiple community organizations and groups in all 15 counties served by the Oxford Office (Alcorn, Benton, Calhoun, DeSoto, Grenada, Lafayette, Marshall, Panola, Pontotoc, Tate, Tippah, Tishomingo, Prentiss, Union, and Yalobusha).

Medicaid Didn’t Take My House—Did It?

Many people believe that if they receive Medicaid to help pay for nursing home care, Medicaid automatically takes their house.

That’s not exactly how it works.

After a Medicaid recipient dies, the state may be allowed to seek repayment for certain benefits paid on their behalf. This is called Medicaid Estate Recovery.

But there may be ways to protect the family home and avoid surprises:

*Plan ahead. Don't wait until a crisis.

*Make sure your property is titled correctly.

*Understand who actually owns the property. Heirs' property can create major problems.

*Have the right legal documents in place.*

*Get legal advice before transferring your home or other property. Giving property away without understanding the rules can create problems with Medicaid eligibility.

The good news? There may be protections, exemptions, and exceptions depending on your family's situation.
