Eastwood Legal Update

Dear Residents,
As some of you are aware, the non-jury trial was held last week in the four (4) count lawsuit that Benge Corp. and Eastwood Golf Club, LLC, filed against Orange County related to the County Commission’s denial of their attempt to build 304 homes on certain golf course property within Eastwood. Over the course of four (4) days, the Court heard testimony from nine (9) witnesses. Unfortunately, the Court ran out of time last Thursday before hearing testimony from the final trial witness. Thus, the Court has placed the matter back on the docket for September 14 through October 2, 2026, for one (1) day to complete the trial. At this juncture, it is not known on what day the trial will be completed.
Because the trial is still ongoing, it would not be prudent for the Association to speculate about the trial, the testimony, potential outcomes, or what the Court may ultimately decide. Rather, the Association will allow the legal process to run its course.
We will provide another update upon the conclusion of the trial or the Court’s issuance of any rulings in the interim.

We are giving out the small 250th American Anniversary Flags that were displayed around Eastwood for the 4th of July.

They are available at the cabana office and are free to the residents. Limit of 2 per household. Available while supplies last.
