Across the country, cash bail continues to exacerbate the wealth gap and penalize lower income families for their inability to post bail. This directly impacts Black and Hispanic families, since they are more likely than white families to be below the poverty line before their arrest. Black felony defendants are 25% more likely to be held pre-trial and receive bail amounts up to twice as high as white defendants accused of the same crime. In Florida, 48% of the state’s prison population is Black, despite only comprising 16% of Florida’s overall population. Florida Bail Fund addresses these disparities by posting bail for lower-income individuals as they await trial.
