To the Members of CozyLakers, Inc.,
A member of the Association hand delivered a letter to resident properties/mailboxes throughout the community; the letter was not mailed through the United States Postal Service. Residents alerted the Executive Board to this action and raised concern about a potential violation of federal law.
The Executive Board is concerned that the letter included 1) opinions, 2) false statements, 3) misleading statements, 4) statements intent on generating fear.
The purpose of this communication is to correct the inaccuracies and add clarity to the situation.
On the topic of voting rights: The Lake Association, CozyLakers, Inc., is owned by the people; Full Members paying towards their charter and Chartered Members who are in good standing (meaning Full/Chartered Members who have paid their annual dues). Only those Full or Chartered Members who are named on a property’s deed may vote unless the deeded owner grants a proxy to another member in good standing. This is not a decision made by Janine nor the Executive Board. This is how the organization was legally structured to operate, and the Bylaws are the constitution of the Lake Association.
On the topic of mandatory membership: As repeatedly stated over the past few years, and as referenced in the minutes from 09/17/2023, 04/28/2024, 10/20/2024, and recent Biannual Meeting held 04/27/2025, we, CozyLakers, Inc., are exploring the possibility of mandatory membership. We are in research mode and in the early stages of evaluating what mandatory membership would entail from both a legal and operational perspective. We are investigating the Associations options.
On the topic of process: When the options are identified by Counsel, pros and cons have been discussed with the Membership Committee during working sessions, and a recommendation is ready to be made to the membership, a Special Meeting will be scheduled to present the findings and recommendations to the membership. The floor will then be open to member discussion on the topic.
To be clear: There is NO “aggressive vote” being taken nor intended by the Membership Committee nor Executive Board.
To be clear: Regarding claims such as “the board refuses over the years to entertain any ideas”, and “residents have ideas and opinions and they are consistently shut down, joked about, laughed at”, are egregiously false, misleading statements. During Biannual Meetings the floor is opened to member comments following the Old and New Business segments (as identified on the agenda notifications). Members are invited to attend Executive Board meetings. This is another opportunity to share comments and ideas for Board and Committee consideration. The last Biannual meeting was held on April 27th 2025, and the upcoming Executive Board meeting will be held in July. The date will be announced a minimum three weeks in advance as dictated by the Bylaws. Members also have been provided the email addresses for all Officers. Submitting an email with comments and ideas brings them to Executive Board and Membership Committee’s awareness for discussion during a working session.
Members must communicate their thoughts and ideas to the Executive Board in a professional and effective manner. Though everyone is absolutely entitled to their opinion, sharing opinions without establishing context, doing research, providing supporting evidence, documenting facts and/or identifying sources by which an opinion has been formulated does not serve the Association.
To be clear: The Executive Board and Membership Committee of CozyLakers, Inc. regularly provide a forum for the exchange of all member ideas and we especially encourage members to consider sharing an idea that:
1) aligns with the CozyLakers Mission Statement,
2) is reasonable/workable/viable,
3) is in line with the Bylaws,
4) has a foundation built on facts,
5) includes supporting evidence,
6) is shared in an appropriate manner, at an appropriate time/place.
