We have a new study out today, called Civil Justice Skewed: The Groups and the Billions Spent Advocating for “Tort Reform.” It is essentially a snapshot of the “tort reform” movement today, i.e., the main lobbying and research forces that are spending millions (or more) to enact restrictions on our legal rights. Without even considering dark money election-focused Super PACs, or direct spending by individual companies, what we found was pretty incredible.

This study is also a testament to those who are fighting back, holding the line against astonishing money and influence, and in this Semiquincentennial year, actually respecting the values on which this nation was founded.

A new book is coming out May 12 called “When Companies Run the Courts: How Forced Arbitration Became America’s Secret Justice System.” From Slate: "this system of justice and public accountability has now effectively been largely eliminated across wide swaths of the economy. In its place is a pernicious system that purports to offer an easier, faster path to a resolution—but all too often is irretrievably biased toward finding that resolution in favor of corporations and at the expense of the consumer or employee. This is the system of forced arbitration."

This is the system of forced arbitration.

"Unless there are structural changes to the regulatory law, it’s all going to jump back up again,” said Joanne Doroshow, the executive director of the Center For Justice & Democracy at New York Law School. “There’s a lot of accounting manipulation that goes on in the industry, which most people do not understand and lawmakers do not understand.”

"This is not a consumer protection," one expert said.
