Learning from Iraq: Ten Transitional Justice Lessons for Syria

All those working on transitional justice (TJ) are looking hopefully towards Syria. Building on experiences from Iraq, our legal rights expert Dr. Bojan Gavrilovic presents ten valuable lessons for an effective process for discussion.

While acknowledging that each context is unique and that copy-paste formulas should be avoided, we favor a “lessons learned” approach to advancing progress in post-dictatorship contexts. The goal was to develop practice-based recommendations on what to consider or avoid in order to establish an inclusive, meaningful and realistic TJ model for Syria.

Jiyans Menschenrechtsexperte Dr. Bojan Gavrilovic erklärt: „Auch seit dem Sturz von Assad kam es in diesem Jahr immer wieder zu Gewalttaten gegen Minderheiten, die zu Pogromen und Massakern an Tausenden führten. Wenn Minderheiten um ihr Leben fürchten müssen, ist der Zeitpunkt, Übergangsjustiz, Versöhnung und Friedensförderung einzuleiten, noch nicht erreicht. Erst wenn alle Menschen nachhaltig geschützt sind, können die Voraussetzungen für eine funktionierende Übergangsjustiz zum stabilen Aufbau des Landes erreicht werden. Dies ist aktuell definitiv noch nicht der Fall. Vor diesem Hintergrund ist es zum jetzigen Zeitpunkt völlig unangebracht, überhaupt über eine Rückkehr der Geflüchteten nach Syrien zu sprechen.“

For JusticeInfo - Fondation Hirondelle, our Head of Program for Rights and Justice Dr. Bojan Gavrilovic sheds light on underlying factors that may have contributed to the premature closure of the Investigative team to promote accountability for crimes committed by Da’esh/ISIL (UNITAD) in Iraq.

Despite UNITAD's successes in collecting evidence and establishing a survivor-centered criminal accountability mechanism, the mission ended in last September at the request of the Iraqi government, that only seven years earlier asked for such a body to help bring ISIS criminals to justice.

One of the greatest losses at least currently is the huge body of evidence collected, which will now basically be archived by the UN with no means to access it.

But it also deals a great blow to survivors and acquaintances of victims that put their trust in the system, provided crucial information, revisited traumatic events, hoped for justice, and will now see their efforts being buried deep in UN's basements.

It's therefore incumbent upon Iraq and the UN to come up with solutions that restores trust and makes the evidence accessible.

Im Artikel berichtet u.a. unsere Kollegin Nada Salim aus Alqosh über die Verstetigung sowie Weitergabe von Traumata: „Je länger sie nicht behandelt werden, desto schwieriger ist es, sie zu bewältigen.“ Da Fördermittel rückläufig sind, ist diese Unterstützung jedoch zunehmend gefährdet.
Die Jiyan Foundation appelliert daher an die Bundesregierung, Abschiebungen von Jesiden in den Irak zu stoppen und sich gleichzeitig bei der irakischen Regierung für die konsequente Umsetzung des Yazidi Survivors Law einzusetzen.

Mental health is a universal human

Many in Iraq and Syria have experienced wars, armed conflicts, the loss of property and loved ones, and their homes. War does not end when the shooting stops, but people deal with their experiences for years to come. The people and their governments are then tasked with building peaceful societies whilst the wars live inside their heads.
Only healthy minds can overcome the past and build a healthy and peaceful community.
Mental health services are not high on the agenda of public health systems in Iraq and Syria. And many still stigmatise mental health illnesses, creating feelings of shame and guilt. This prevents people from seeking professional support.
“Many people do not have access to treatment, medicine, or community resources for managing mental health conditions“, states Dr. Jamal Omer, a psychiatrist with Jiyan Foundation. “This is also due to a lack of resources in their areas.”
Thus, the prioritization of mental health by national and international bodies is of the utmost importance. We need to improve public health education and investment in mental health research and systems. If, like in Iraq and Syria, mental health does not play an essential role in the public health systems, civil society organisations like Jiyan Foundation play a vital role in mental health service provision and capacity building.
Jiyan Foundation for Human Rights runs nine mental health treatment centers, a clinic for Yazidi women and their children (survivors of ISIS), a Healing Garden and mobile teams supporting survivors in 11 refugees and IDP camps throughout Kurdistan-Iraq, Iraq, and Syria. We offer a range of low-threshold access possibilities for (potential) clients. Since 2005, these programs have supported over 100,000 survivors of war, terror, gender-based violence, and human rights violations in the region.

“Terminating UNITAD Iraq´s mandate in Iraq will have far-reaching negative consequences, as it will prevent putting the collected evidence of ISIL crimes against Yazidis, Shia, Sunni, Christian, Kaka’i, Shabak and Turkmen Shia and others to proper use. Clearly, every mandate comes to an end, but without a sound legislative framework and a clear roadmap on how to ensure delivery of justice in a survivor-centred manner and in line with international fair trial standards, the entire engagement would have been in vain.”
