Fraud Alert: ‼️
We want to share an industry alert regarding potential fraud activity impacting dealerships.

Another state association has identified cases of suspected identity fraud involving out-of-state transactions. While this information is not directly from the DMV, it is worth noting for precautionary purposes.

Common red flags:

Out-of-state buyer (often OH or PA)

Urgent transaction

Provides full ID documentation

Requests financing and sends their own transporter

Best practices:

Verify identity (video or notary)

Confirm the customer address independently

Use ID scanning tools when possible

Maintain control of transport and delivery

Please use your discretion when evaluating transactions

URGENT NOTICE: FTC issues warning letters to 97 dealers about potential violations.

The NIADA notified dealer members on Friday of letters being sent by the FTC to 97 auto dealers concerning potential violations of Section 5 of the FTC Act, which prohibits unfair or deceptive practices (UDAP), as well as unfair methods of competition.

NIADA prioritizes compliance and reminds dealers that it is not just a legal obligation; it is also an important way to build and maintain trust with customers.

Reminder – Airbag Law
DMV is reminding dealers of airbag requirements in the sale of motor vehicles which were
strengthened in law in 2022.
The law requires:
1. All used motor vehicles sold at retail to be equipped with an operational inflatable
restraint system (air bags) which conforms to the applicable federal motor vehicle safety
standard (49 CFR 571.208) that was in effect on the date of manufacture. The air bag
readiness indicator light must illuminate momentarily as the vehicle is being powered up
and must not remain illuminated nor flash intermittently while the vehicle is being driven
(see VTL § 419-a).
2. The invoice or bill of sale for all used motor vehicles sold at retail must contain the
following statement:
“The dealer named above further certifies that this vehicle complies with the
inflatable restraint system requirements found in section 419-a of New York
State Vehicle and Traffic Law.”
This statement must: (1) be of the same color, size and font as the used vehicle
certification statement; and (2) immediately follow the used vehicle certification
statement (see VTL §417).
Non-compliance with this requirement is a significant public safety risk.

DMV_VERIFI Message #140 VERIFI - PRESIDENTS DAY WEEKEND and NYVIP Message #321 - NYS INSPECTIONS AVAILABLE – PRESIDENTS DAY WEEKEND

DMV Confirms to NYIADA That Dealers May Continue Using VERIFI and NYVIP 3 During Shutdown
The New York State DMV has advised that it will be performing scheduled system upgrades beginning Friday, February 13, with completion expected by the afternoon of Tuesday, February 17. During this time, certain DMV systems and offices will be unavailable.

The DMV has confirmed, however, that this temporary shutdown will not impact dealers’ ability to process electronic VERIFI transactions or conduct vehicle inspections.

Dealers should have received two separate communications from the DMV on 1/27/26

DMV/VERIFI Message #140, indicating that electronic VERIFI processing will continue uninterrupted during the outage.

NYVIP Message #321, confirming that NYVIP3 will remain fully operational throughout the shutdown period.

Dealers enrolled in the DMV Partnering Program will receive additional details directly from the DMV regarding online registrations. Please monitor your email closely for those updates.

DMV/VERIFI Message #140
The New York State DMV is upgrading it systems over Presidents Day Weekend.
THERE ARE NO EXPECTED IMPACTS TO COMPLETING ELECTRONIC TRANSACTIONS IN VERIFI The VERIFI system is expected to be available and able to process transactions throughout the upgrade period with one minor exception:  The optional entry field for the drivers’ license number during a retail transfer will be temporarily removed. As always, if there is any unplanned system outage, dealers are permitted to use secure paper MV-50s (see VERIFI messages #99 and #137). If used, any paper MV50 sales must be entered into VERIFI PROMPTLY WITHIN 48 hours. All transactions should be attempted electronically in VERIFI even if a previous transaction required the use of a secure paper MV-50. Dealers are responsible for maintaining an adequate supply of secure paper MV50s. Dealers should review inventory levels now and order stock if needed to ensure their ability to transfer vehicles is not affected by any outage, related to the system upgrade or otherwise. The upgrade is scheduled to begin at 6pm on Friday, February 13th, 2026, and is anticipated to end the afternoon of Tuesday, February 17th, 2026. DMV strongly encourages that all users of the VERIFI system closely monitor the system for any additional messages.

INFORMATION REGARDING DMV SYSTEM UPGRADE
ANNOUNCEMENT
DMV announced a planned system upgrade Presidents Day Weekend during which DMV offices
will be closed and services will not be available.
THERE WILL BE NO IMPACT ON NYVIP3 OR YOUR ABILITY TO PERFORM INSPECTIONS.
The New York Vehicle Inspection Program (NYVIP) System WILL be available and able to
complete inspections uninterrupted during the planned NYS DMV upgrade.
The upgrade is scheduled to begin around 6pm on Friday, February 13th, 2026, and is
anticipated to end Tuesday, February 17th, 2026.
As always, carefully review all messages sent over the Computerized Vehicle Inspection System
(CVIS).
Other DMV services related to the inspection program will be unavailable during the upgrade
period. Please take care of all needed actions related to the following services prior to or after
the identified upgrade period:
1. Certified Inspector applications, amendments, renewals, testing, and training.
2. Body Damage Estimator applications, amendments, and renewals.
3. DMV SAFIRE credit balance inquires.
The Opus website www.NYVIP3.com will have notifications in place with the system limitations
throughout the upgrade.
