Did you know that the Town of New Lisbon has a Site Plan Review law? Do you know what a Site Plan Review law is and why towns often have one?
New Lisbon’s Site Plan Review law is fairly typical. In a nutshell, it provides that, with certain exceptions, all new Land Use Activities require approval of a Site Plan by the town prior to commencement of the new use.
As stated in the law, our Site Plan Review law is premised on the belief that "A clean, wholesome, attractive environment is [ ] of importance to the health and safety of the inhabitants of the Town and in addition, such an environment is [ ] essential to the maintenance and continued development of the economy of the Town and the general welfare of its inhabitants."
The law "is not intended to prohibit any lawful land use activity but to require all proper land use activities to meet minimum standards."
The exceptions to the new Land Use Activities that require Site Plan Review include, among others: construction of one or two family dwellings and accessory structures; agricultural operations (other than construction of buildings or processing facilities); sale of agricultural produce; seasonal produce stands; short term garage sales; home occupations with no non-resident employees and customers.
So, if you are planning a new Land Use Activity on your property (or if you have already undertaken such new use without prior site plan review), you are encouraged to check the town’s Site Plan Review law and, if necessary, to submit a Site Plan as described in the law to the Town Clerk for review by the Planning Board and approval by Town Board.
