In the state of North Carolina and in legal context, the term “polar star” refers to the standard that courts must adhere to when determining what is in a minor child’s best interest and welfare. The courts base their decisions on this consideration and strive to never lose sight of the brightest star guiding their judgments. It is evident that these children love and adore their mom. Their childhood has been filled with endless happy memories, love, learning and nurture because of her determination to give them the most beautiful life possible. Before these children were ripped from their home, they enjoyed dance, Girl Scouts, Minor T-ball, and had just signed up to attend “youth group” at a local church. Aubreigh was excelling in school, reading chapter books and preforming above grade level. Ayden was enrolled in a Pre-k program where he was ”class leader” and learning math, writing, religion, reading and Spanish. Aubreigh wanted Sarah to be “class mom” and was extremely excited when she agreed to do it. They resided in a neighborhood filled with other kids and were often playing outside and creating memories. These children had everything they could ever want and need provided by their mother. They were safe, happy, healthy and thriving. In North Carolina, a temporary order for custody which changes the living arrangements of a child or changes custody shall not be entered ex parte and prior to service of process or notice, unless the court finds that the child is exposed to a substantial risk of bodily injury or that there is a substantial risk that the child may be abducted or removed from the State of North Carolina for the purpose of evading the jurisdiction of North Carolina courts. As a reminder, making false allegations in order to obtain custody of minor children, not only negatively impacts the case itself but also the children and parents involved. Had someone been so compelled to do so, there were other ways to go about this that would have been less traumatizing, upsetting and confusing to the children. Over the next few weeks, we pray the court does not lose sight of their “polar star” and bring these babies home to their mother where they belong.
