Yes..."Have You Heard" that the attached notification of a regularly scheduled Board Meeting was distributed outside of the timeframe stipulated within Davis-Stirling? Specifically, Davis-Stirling cites Civ. Code § 4920 that states a requirement for the board meeting notice to include an agenda for that given meeting. Tied to that is Civ. Code § 4920(a) which states unless the governing documents require a longer notice period, members MUST be notified of the time and place of board meetings at least four (4) days before the meeting is held. El Rancho Loma Serena has always relied on both the gate signs and the agenda distribution to achieve this. The agenda for tomorrow (Saturday) was not distributed until this Wednesday morning at 5:40 AM. That timeframe fails to meet the 4 day legal requirement.
As of this writing, the HOA Board President plans on opening the meeting for comments only and postponing the remainder of the meeting agenda content to another date. The Board will then move into Executive Session to deal with disciplinary matters and a foreclosure approval.
One has to question if the disciplinary matters will include the fact that our HOA Webmaster has now, on two occasions, failed to provide timely notification to the Membership on behalf of the Board of Directors. It should also be noted that the majority of the web portal is out of date.

Well Folks! This is a bit late notice and apparently our Board President preferred to have this be shared via "word of mouth," instead of using the official web site or an e-mail push. The recently published El Rancho Loma Serena Newsletter was distributed 9 days ago. Within that newsletter was an article that has been attached for review. While some of the content in the article is open to Member opinion, it is also true that the Board has approved the formation of a committee to identify what is involved in altering the scope of the current HOA to one with a focus that is considered to be Roads Only.
The Committee has held it's first meeting and laid out a purpose statement for the team, identified the effort’s objective and defined a high level project scope definition. The team members areas of expertise have been identified and each were assigned to general project areas.
Yes, this effort represents the potential for significant change which is why the first thing the team will be undertaking is a Member Survey. The Committee wants to gather input from those who actually make up the Homeowners Association -- The Members. Look for more information about this in future newsletters or here on Facebook.
If you have a desire to learn more about the effort or become involved in some way, feel free to contact members of the subcommittee here via private message. This Association belongs to 148 Lot Owners. This is an opportunity to have a say in how it may be structured and managed going forward.

We received a request from an Association Member to post the following:
The new lot owners on Rustlers Pass have been experiencing ongoing issues with their dogs getting out and now one of them is seen to be somewhat aggressive. The medium sized dog that is cream colored with brown spots apparently tried to bite an individual this morning while they were out walking on the road.

Please note Article 7: Pets And Livestock in the CC&Rs specifically states:
Item 7.2 - Pets are permitted in the Common Areas including Common Area Roadways; and must be under the control of their owner at all times.

Long Time No Post! When there is little to share, there isn't much need for postings.
** HOWEVER ** Tomorrow is the HOA Annual Meeting.
As always, that meeting starts at 1:00 PM and lunch is provided prior to the meeting officially kicking off.
The agenda is a pretty full one with some content that involves lot owners, such as a presentation about the use of grazing to reduce fuel loads (read that to mean Fire Safety), and an interactive discussion pertaining to Lot Owner engagement within our Community.
Please attend. Your involvement - or lack thereof - impacts the community more than you know!

The HOA Board of Directors called a special meeting for this morning at 9:06 AM at the HOA Ranch House. A full complement of Board Members was present, as well as 4 lot owners. It was noted by the President that while the gate signs were posted well within the meeting notification legal statute, the distribution of the agenda was not. This is essentially a non-compliance issue with the Davis-Stirling Act. The meeting agenda e-mail to the Membership was timestamped as received at 9:57 PM. The Board discussed the situation and chose to proceed with the meeting. The HOA Webmaster will be counseled on legal statute requirements.

There was nothing new to report relative to prior Executive Sessions.

Two sets of minutes from April 12, 2025 and April 24, 2025 were motioned and approved. The Webmaster will be asked to post these minutes to the Web Portal.

The Road Committee met to close on work to be performed on cracks in our HOA roads. Requests for a total of three bids will be distributed for work to be performed. The current approved funding amount is not to exceed $14,400.00 for the work.

Three items were brought up during open session.
1) The Reserve Study is completed and has been sent out. The Webmaster will be asked to post it to the HOA Web Portal.
2) The status of the trailer that still remains on Lot 130 was asked about. An additional letter was sent instructing the Lot Owners to remove the 5th wheel. They were given 30 days to accomplish that task. There are no exceptions for trailers on lots for the purposes of performing work within our CC&Rs, and what is allowed is that which is stated within the Calaveras County Civil Code. It was also noted that there has also been a complaint filed with Calaveras County on the same trailer given it is not in “cold storage,” as defined by County Code.
3) There was also discussion about speed on HOA roads. One lot owner nearly had a head-on due to someone driving well over the posted 15 MPH speed limit for our private roads. In addition, the lack of volunteers to execute a worthwhile road day, as well as the wet winter we had, has plant growth having an impact on visibility. With that in mind, people need to SLOW DOWN and ADHERE TO THE POSTED SPEED LIMIT in the HOA. This concern will be reinforced in the June Newsletter.
4) It was also noted that we have two parcels on the West Side that have active offers working on them. Hopefully these are buyers who will work to develop the lots again.

The meeting broke into Executive Session at 10:06 AM.
