Yes..."Have You Heard" that the attached notification of a regularly scheduled Board Meeting was distributed outside of the timeframe stipulated within Davis-Stirling? Specifically, Davis-Stirling cites Civ. Code § 4920 that states a requirement for the board meeting notice to include an agenda for that given meeting. Tied to that is Civ. Code § 4920(a) which states unless the governing documents require a longer notice period, members MUST be notified of the time and place of board meetings at least four (4) days before the meeting is held. El Rancho Loma Serena has always relied on both the gate signs and the agenda distribution to achieve this. The agenda for tomorrow (Saturday) was not distributed until this Wednesday morning at 5:40 AM. That timeframe fails to meet the 4 day legal requirement.
As of this writing, the HOA Board President plans on opening the meeting for comments only and postponing the remainder of the meeting agenda content to another date. The Board will then move into Executive Session to deal with disciplinary matters and a foreclosure approval.
One has to question if the disciplinary matters will include the fact that our HOA Webmaster has now, on two occasions, failed to provide timely notification to the Membership on behalf of the Board of Directors. It should also be noted that the majority of the web portal is out of date.
Does the Membership find this acceptable?
