Willful Infringement — Corroborated Prior Notice — Multiple Witnesses
I. IDENTIFICATION OF CLAIMANT
This letter constitutes a FINAL DEMAND issued by Bishop Dr. Osiris Imhotep, Founder and Executive Director of the Mount Vernon Film Festival (hereinafter "Claimant"). Claimant holds duly registered rights to the trade name and mark "Mount Vernon Film Festival" in the State of New York, including a Certificate of Assumed Name (DBA) and a New York State Trademark Registration filed with the New York County Clerk's Office, both predating your organization's existence.
II. PRIOR NOTICE — CORROBORATED BY MULTIPLE WITNESSES
This is not Claimant's first communication to you on this matter. You have been warned. Twice.
In 2025, Claimant issued direct warnings to your organization through two independent channels: (1) written notice via email, and (2) direct verbal notice. Both warnings explicitly informed you that the name "Mount Vernon Independent Film Festival" infringes upon Claimant's registered mark and demanded that you rebrand.
Claimant is in possession of the 2025 written email correspondence. Additionally, multiple independent witnesses were present during the verbal warning and are prepared to provide sworn testimony confirming that your organization received direct, unambiguous notice of the infringement and the demand to rebrand.
Despite this documented, corroborated prior notice, you have willfully continued to operate under the Infringing Mark. This transforms your conduct into knowing and deliberate infringement — a distinction that carries significant legal consequences,
