Today the United States Supreme Court issued a ruling in 303 Creative v. Elenis, that will allow businesses to turn away customers simply for being who they are.

This ruling broadly erodes the power of important civil rights protections at a time when our LGBTQ+ communities are under attack across the country.

We are in touch with state leadership and our partner organizations and will share more information as we continue to respond to this ruling and its impacts on protections here in Minnesota.

We know that our communities are stronger when we are all welcome—when we can live and thrive as our full, authentic selves. We know that inclusion is not just the right thing to do, it’s good for businesses. And we will keep fighting here in Minnesota and beyond to build a more equitable world.

In solidarity.

"The meaning of our Constitution is found not in any law volume, but in the spirit of the people who live under it. Every business owner in America has a choice whether to live out the values in the Constitution."

Justice Sotomayor, dissenting

THE SUPREME COURT HAS RULED AGAINST AFFIRMATIVE ACTION FOR COLLEGE ADMISSIONS (6/29/23)

What does this mean?

What is affirmative action? Regarding college admissions, race-conscious admissions practices have been employed to craft diverse, inclusive student bodies through the consideration of an applicant's race alongside all other parts of their application. This was done to rectify historic inequalities in the United States that were the result of legal systemic racism.

What has the court ruled? By a vote of 6-3, the SCOTUS ruled that the consideration of race in college admissions was unconstitutional. The majority opinion stated that applicants must be assessed on their experience as individuals rather than race, and that colleges are racially stereotyping applicants, which contradicts the equal protection clause of the 14th Amendment.

What are the implications? Despite progress that has been made to ensure racial equity in higher education, significant barriers are still present for many Black, Hispanic, and Indigenous applicants. By eliminating the consideration of race, the proactive effort to include students of these backgrounds will be hindered. This could lead to colleges and universities having less diverse student bodies, which is detrimental to efforts for racial equality.
