The recent WCCO report on products containing CBD and other cannabinoids raised troubling questions about the reliability of product labels. We urge everyone in the cannabis industry to assure that product labels are accurate. Our customers deserve the truth.

As to the legality of h**p-derived products, we continue to seek clarity from governmental regulators. We pride ourselves on providing safe, reliable products to our customers. By failing to define terms such as “intoxicating,” however, governmental regulators do nothing to clarify the legality of various products. What could be intoxicating for one person might not be intoxicating for someone else. We look forward to continuing to work closely with Minnesota legislators and regulators to craft laws and regulations that provide clarity on the legality of h**p-derived products.”

WCCO tested ten popular products at a lab recommended by the Department of Agriculture in February. The chemist found some discrepancies with what the label said versus what was inside. WCCO's Jennifer Mayerle learned some types of products are illegal in the state.

On August 21, 2020, the federal Drug Enforcement Agency (DEA) issued an interim final rule relating to the legality of h**p extracts. The new rule identifies any h**p extract with a delta-9 THC level above 0.3% as Schedule I controlled substance under federal law. The new rule is effective immediately.
