How Clients Can Protect Themselves

In light of recent developments involving S2, tenants should continue taking proactive steps to protect their tenancy and document all efforts to remain in compliance. Allegations involving a landlord do not eliminate a tenant’s responsibility to pay rent or comply with lease or court obligations.
• Continue Making Rental Payments: If an online payment portal is available, continue making rental payments through the established system.
• Document All Attempts to Pay Rent: If the portal is unavailable or in-person payment cannot be made, obtain a money order for the rent amount, keep a copy or photo of the money order and receipt, and document all attempts to submit payment through email, text, or written communication to property management. Retain all records.
• Prepare for Future Rent Collection: Be aware that unpaid rent may still be pursued at a later date. Maintaining proof of attempted payment may help protect against future disputes regarding arrears.
• Follow Existing Court Orders: If you have a court-ordered payment plan or move-out agreement, continue complying with the terms of that order unless modified by the court.
*For court-ordered payment plans, continue making payments and documenting compliance as outlined above.
*Do not assume a landlord’s legal issues suspend or change court obligations without confirmation from the court or legal counsel.

•Address Property Condition Concerns: If there are serious habitability or property condition concerns (such as lack of heat, water issues, unsafe conditions, or code violations), tenants should contact the City of Milwaukee Department of Neighborhood Services (DNS Milwaukee) to file a complaint and request an inspection. Be sure to document conditions with photos, written notices, and records of complaints submitted.

Recommended Next Steps / Legal Support
• If you have questions about your rights or obligations, seek legal guidance as soon as possible through the Marquette University Law School Volunteer Legal Clinic and/or the The Milwaukee Justice Center.

• If you are currently or were represented through Eviction Free MKE or the Eviction Defense Project, contact your attorney directly for case-specific guidance.

•Continue retaining copies of your lease, court documents, rent payment records, notices, and communications in case additional legal or property management issues arise.

Please note that Community Advocates nor the Milwaukee Rental Housing Resource Center will be accepting tenants' payments.

Last week, RHRC had the opportunity to visit Messmer High School to host a housing workshop for students preparing to become first-time renters.
We talked about the things every young renter should know—tenant rights, red and green flags when apartment hunting, and local housing resources available right here in our community. Students asked great questions and engaged deeply in conversations about how to protect themselves and make informed housing decisions.
Huge thank you to Messmer High School for welcoming RHRC into your school and giving us the chance to share this information with your students. We’re excited to continue supporting young people as they take their next steps toward stable, informed housing.
