How Clients Can Protect Themselves
In light of recent developments involving S2, tenants should continue taking proactive steps to protect their tenancy and document all efforts to remain in compliance. Allegations involving a landlord do not eliminate a tenant’s responsibility to pay rent or comply with lease or court obligations.
• Continue Making Rental Payments: If an online payment portal is available, continue making rental payments through the established system.
• Document All Attempts to Pay Rent: If the portal is unavailable or in-person payment cannot be made, obtain a money order for the rent amount, keep a copy or photo of the money order and receipt, and document all attempts to submit payment through email, text, or written communication to property management. Retain all records.
• Prepare for Future Rent Collection: Be aware that unpaid rent may still be pursued at a later date. Maintaining proof of attempted payment may help protect against future disputes regarding arrears.
• Follow Existing Court Orders: If you have a court-ordered payment plan or move-out agreement, continue complying with the terms of that order unless modified by the court.
*For court-ordered payment plans, continue making payments and documenting compliance as outlined above.
*Do not assume a landlord’s legal issues suspend or change court obligations without confirmation from the court or legal counsel.
•Address Property Condition Concerns: If there are serious habitability or property condition concerns (such as lack of heat, water issues, unsafe conditions, or code violations), tenants should contact the City of Milwaukee Department of Neighborhood Services (DNS Milwaukee) to file a complaint and request an inspection. Be sure to document conditions with photos, written notices, and records of complaints submitted.
