Florida AG James Uthmeier last week sued OpenAI and its CEO Sam Altman, alleging that the AI company’s ChatGPT endangers children and is responsible for aiding and abetting su***des and mass shootings.
The lawsuit seeks civil penalties for alleged violations of the state’s unfair trade practice, product liability, public nuisance and negligence laws.
“People are getting hurt, parents are getting deceived, and they need to pay for it,” Uthmeier said. “They need to pay for it by opening up their checkbook and changing the program to ensure that there are parental controls and that we are not endangering our kids.”
In March, Uthmeier opened a separate criminal investigation after it was revealed that ChatGPT allegedly offered advice to the suspected gunman in last year's mass shooting at Florida State University that resulted in two deaths.
The lawsuit comes as prospects for federal legislation to address AI before the midterm elections remain unclear, and a month after a special legislative session in Tallahassee failed to produce legislation to regulate the AI industry by requiring parental consent for a child to open a companion chatbot account. Christian Family Coalition (CFC) Florida had lobbied for the bill, which was backed by Governor Ron DeSantis.
AI has been involved in more than one teen su***de. In 2024, 14-year-old Sewell Setzer III of Orlando committed su***de after developing an unhealthy relationship with a chatbot that encouraged him to kill himself.
"We thank Attorney General Uthmeier for taking the issue of AI's dangers to children and the general public seriously and filing this first in the nation lawsuit against OpenAI," said CFC Florida Founder and Executive Director Anthony Verdugo.
