With closing arguments scheduled for tomorrow, it’s time to finish the job! After Friday’s fireworks exposing massive credibility issues with NASCAR exec Eric Nyquist after his own employee Mike Forde ok’d the BMS press release as “being let’s go Brandon but they positioned it ok”, both Jerry Brown and Nyquist stating that Nyquist gave the example that Trump ‘24 was political but Trump Hotel wasn’t, and NASCAR’s expert threatening to physically attack , it has been a hard fought week in court. NASCAR has already brought in a team of appellate lawyers to manage the end of trial but judge Lisa Walsh has presided over trial with extreme care to avoid appealable issues.

UPDATE: Rather than fly a slew of people in midweek and be split over the weekend and Rosh Hashannah, Judge Walsh has given us the entire week of September 29 for our trial. Slight delay, but far superior logistics. Letsgoooooo!

At today’s pre-trial hearing our case was slated as second in line to go to trial September 15. Hopefully the other case is resolved quickly so justice for our project can finally get underway!

Our trial date is set for the window beginning September 15, 2025 in Miami complex civil division. As of now this trial will be limited to the Foundation’s 96M$ claim for reasonable reliance on NASCAR’s written sponsorship approval and wrongful act damages for representatives getting wrongfully sued (after the judge reversed her own previous ruling that the foundation had the right to sue on behalf of all coins). We are challenging that reversal and will help organize another suit, if needed, to make sure every coin holder has their day in court against NASCAR. LETSGO!

For those not in our telegram, the judge in our NASCAR issued an order last night that reversed her previous decision that the Foundation has standing to sue on all coins behalves, and the Foundation can only take its promissory estoppel count to trial. This is disappointing news, especially on a holiday weekend, as it will require us to restructure the suit to bring already overdue justice to coinholders, but we will keep fighting until we do so.
